For the purpose of this chapter, the following terms shall have the meaning indicated:
CONSTRUCTION SITE
That area, lot or parcel of ground on which any demolition, construction, reconstruction, alteration, renovation, or repair shall take place.

A. 
If a construction site one or more portable lavatories, the same must located at least eight feet back from the curbline and located on the actual construction site and not on the street and not on the public sidewalk or area designated for the sidewalk, and the same shall not be located in the public right-of-way.
B. 
The location of the portable lavatories shall be such to minimize adverse aesthetic conditions and to minimize any effect on any neighboring or adjourning properties. Portable lavatories located on construction sites that are residential properties shall be located in the back of the properties in furtherance of minimizing adverse aesthetic conditions.

A. 
Any portable lavatories maintained in or in connection with any construction site shall be kept clean at all times and shall be cleaned at least once each week.
B. 
Such cleansing at minimum shall include:
(1) 
Removing the waste inside the tank of the portable lavatory.
(2) 
Cleaning the inside of the portable lavatory to prevent mold accumulating, and to stop bacteria and virus development.
(3) 
Application of deodorizing agent to prevent odor and spread of bacterial and viral matter.
(4) 
Restocking all essential consumables such as hand towels, soap, and sanitizer.
C. 
The name, address and telephone number of the person responsible for the maintenance of the public lavatory shall be affixed to the entrance of the lavatory together with the date on which the lavatory was last maintained in accordance with § 153-3B.
D. 
The portable lavatories maintained in or in connection with any construction site shall be locked at the end of the work day.

A. 
This chapter shall be enforced by any one or more of the following:
(1) 
The Health Officer.
(2) 
The Construction Official.
(3) 
The Department of Public Works.
(4) 
Any member of the Orange Police Department.
B. 
The Health Officer or a designee shall be responsible for weekly inspections of the portable lavatories regulated by this chapter.

Any violation of this chapter by a company or person shall subject the violator to a fine not to exceed $1,000. Such fine may be imposed for each separate day of the violation.
