Hereafter it shall be unlawful for any person or persons, partnership, corporation or company to distribute, throw or deposit, or cause to be deposited, any handbills, dodgers or other advertising devices in, into or upon any of the streets, alleys, sidewalks, yards or doorways of residences within the limits of the Borough, provided that this section shall not apply to the distribution of newspapers in any manner or to the distribution of any material or article through the United States Mail or to the handing of any literature or article to any person willing to receive it.[1]

Any person or persons, or corporation, partnership or company or their agents, who or which violates § 134-1 of this chapter, shall for every such violation, upon conviction, be sentenced to pay a fine of not more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days.

From and after the enactment of this chapter, it shall be unlawful for any person or persons, association, partnership or corporation to place or attach, or cause to be placed or attached, any posters, signs, cards or advertising matter whatsoever upon poles or elsewhere upon any buildings or property owned or occupied by the Borough of Etna or within the rights-of-way of the streets, roads and public ways of the Borough of Etna; provided, however, that such prohibition shall not apply to any posters or signs placed which are erected by or required to be erected by any governmental body.

Any person or persons, association, partnership or corporation who or which violates any provision of § 134-3 of this chapter shall, for every such violation, upon conviction, be sentenced to pay a fine of not more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days, provided that each attachment or posting shall constitute a separate violation and each day that any such attachment or posting remains shall constitute a separate violation.
