[HISTORY: Adopted by the Borough Council of the Borough of Etna 3-8-1971 by Ord. No. 1032 (Ch. IX, Part 5, of the 1974 Code of Ordinances). Amendments noted where applicable.]
An exclusive franchise, or consent to erect, maintain and operate transmission and distribution facilities in, under, over, along, across, and upon the streets, lanes, alleys, avenues, bridges, highways, and other public places for the purpose of transmission by cable and distribution of television impulses and energy for the sale to the inhabitants of the Borough of Etna, Allegheny County, Pennsylvania, is hereby granted to Video Link of Allegheny County, Inc., a Pennsylvania corporation.[1]

Editor's Note: The preamble to this ordinance stated that Video Link of Allegheny County, Inc., had made application to the Borough for an agreement authorizing it to erect, maintain and operate transmission and distribution facilities in the Borough; and that the Borough was willing to grant the license or franchise under the terms and conditions set forth in an agreement between the Borough and the licensee. Section 3 of this ordinance repealed all conflicting ordinances and parts of ordinances insofar as the same affected this ordinance.
The proper officers are hereby authorized and directed to execute and deliver an agreement between the Borough of Etna and Video Link of Allegheny County, Inc., in substantially the form of an agreement presented at this meeting, the terms of which are incorporated herein by references.[1]

Editor's Note: Ordinance 1107 (December 29, 1977) directed the Borough Solicitor to re-draft Section 17 of the agreement, fixing subscriber service and maintenance charges from January 1, 1978 to June 30, 1978, and from July 1, 1978 to December 31, 1980; providing for 10% discounts for persons over 65 years of age; and stating that no additional channels or services were to be added by the Company without prior approval by Borough Council. It further directed the proper Borough officials, after adoption and execution of the amendment by the Company, to execute the agreement.
