The Borough of Etna hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101 to 7210.1103, as amended from time to time, and its regulations.
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 to 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the Borough Building Code of the Borough of Etna.
By virtue of the submission of the Borough of Etna to the jurisdiction of the Allegheny County Health Department pursuant to the Local Health Administration Law, 16 P.S. §§ 12001 to 12028, the Allegheny County Health Department shall administer and enforce the International Plumbing Code, Plumbing Chapters 25 through 32 of the International Residential Code, and Article XV of the Allegheny County Health Department Rules and Regulations. Article XV shall take precedence over the International Plumbing Code, Plumbing Chapters 25 through 32 of the International Residential Code where the requirements of Article XV exceed the requirements of the International Plumbing and Residential Codes.
Administration and enforcement of the code within the Borough of Etna shall be undertaken as follows:
A. 
By the retention of one or more construction code officials or third-party agencies to act on behalf of the Borough of Etna;
B. 
With reference to electrical inspections, the applicant must furnish proof of certification by the Department of Labor and Industry of the Commonwealth of Pennsylvania furnishing proof that the third-party agency is certified for electrical inspections, as per the "Detailed Listing of Certified Third Party Agencies" located on the website for electrical inspections of the Department of Labor and Industry of the Commonwealth of Pennsylvania;
C. 
The Allegheny County Health Department, Plumbing Division, is hereby designated to administer and enforce the International Plumbing Code, Chapters 25 through 32 of the International Residential Code, Article XV of the Allegheny County Health Department Rules and Regulations through permitting and inspection.
A board of appeals shall be established by resolution of the governing body of the Borough of Etna in conformity with the requirements of the relevant provisions of the code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said board of appeals shall be established by joint action of the participating municipalities, except that any appeals filed with respect to the International Plumbing Code, Chapters 25 through 32 of the International Residential Code and Article XV of the Allegheny County Health Department Rules and Regulations shall be conducted in accordance with Article XI of the Allegheny County Health Department Rules and Regulations.
A. 
All building code ordinances or portions of ordinances which were adopted by the Borough of Etna on or before July 1, 1999, and which equal or exceed the requirements of the code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the code, as amended from time to time.
B. 
All building code ordinances or portions of ordinances which are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the code are hereby amended to conform with the comparable provisions of the code.
C. 
All relevant ordinances, regulations and policies of the Borough of Etna not governed by the code shall remain in full force and effect.
Fees assessed by the Borough of Etna for the administration and enforcement undertaken pursuant to this chapter and the code shall be established by the governing body by resolution from time to time, except those fees as required by the Plumbing Division of the Allegheny County Health Department.
This chapter shall be effective five days after the date of passage of this chapter.
If any section, subsection, sentence, or clause of this chapter is held, for any reason, to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this chapter.
