All owners of buildings in the Borough of Etna shall be required
to register with the Secretary of the Borough a statement of the kinds
and classes of occupancy existing in any building or buildings owned
by said owners. No dwelling house, apartment or other living quarters,
commercial or industrial establishments may be occupied by new occupants
until such time as the owner has secured an occupancy permit to be
issued by the Secretary of the Borough or the Borough Building Inspector,
as designated by Council.
The Secretary of the Borough is authorized and directed to prepare
and forward to owners the necessary registration forms required to
effectuate the intention of this chapter and to administer its provisions.
The application for the occupancy permit shall disclose the following
information:
B. Name and address of the owner.
F. General condition of premises.
G. The application shall also disclose the names and occupations of
all occupants.
No permit shall be issued until such time as the premises are
deemed to be in a livable and habitable condition after an inspection
by the Building Inspector, Fire Marshal and/or other such persons
as the Council of the Borough may require from time to time.
Any owner of a building or other persons found guilty of wilfully
evading or violating the provisions of this chapter shall, upon conviction
thereof, be subject to a fine of not more than $50 for each violation,
and each day's violation shall be considered a separate offense. All
ordinances or parts of ordinances inconsistent herewith are repealed.
