No person shall establish or maintain any nursery school or child care center for the care and training of children of pre-school age, without first having obtained a license therefor from the board covering all the premises intended to be so used. These premises must conform to the building and zoning ordinances of the borough.

Every nursery school or child care center shall meet the following requirements:
a. 
Every application for a license shall be in writing and it shall contain a full description of the premises and building intended to be used for such purpose and satisfactory proof that every person employed thereat is free from communicable disease.
b. 
Every license issued under this chapter shall state the name, or names of the licensee, or licensees, location of the licensed premises, and the maximum number of pupils to be cared for at one time.
c. 
No license for a nursery school or child care center shall be issued until the board is satisfied that the State of New Jersey Department of Human Services has approved the said facility.

a. 
A nursery school or child care center shall be considered in the same category as a restaurant, if food is being served, and shall be subject to the same regulations as apply to a restaurant. However, payment of only one license fee would be required for such an establishment.
b. 
A nursery school or child care center shall be subject to the same regulations as "Public Places" referred to in Chapter BH20.
