The Borough of Englewood Cliffs shall permit all volunteer public safety organizations of the Borough certain that qualify as charitable organizations under N.J.S.A. 45:17A-20 to solicit contributions in roadways situate in the Borough of Englewood Cliffs in accordance with the provisions contained herein.

All volunteer public safety organizations of the Borough that qualify as charitable organizations as defined in N.J.S.A. 45:17A-20 who desire to solicit contributions in roadways situate in the Borough of Englewood Cliffs shall file an application for a permit with the Englewood Cliffs Borough Clerk on a form supplied by said Clerk specifying the following information:
a. 
Name of applicant organization.
b. 
Address of applicant organization.
c. 
Telephone number of applicant organization.
d. 
Contact person of applicant organization.
e. 
Specific location or locations of proposed charitable solicitation.
f. 
Dates and times of proposed charitable solicitation.
g. 
If said request pertains to a location or locations on any County highway, or intersection with a County highway, any approval by the Mayor and Council will be conditioned upon, the applicant obtaining written authorization from the Bergen County Board of Commissioners to permit said charitable solicitation. After receiving conditional approval from the Mayor and Council, in order to obtain final approval, the applicant shall submit to the Borough Administrator, at least 48 hours in advance of the solicitation, excluding Saturdays, Sundays and holidays, such executed authorization, which shall convert the conditional approval to final approval.

h. 
If said request pertains to a location or locations on a State highway or intersection of a State Highway, any approval by the Mayor and Council will be conditioned upon the applicant obtaining written authorization from the Commissioner of the New Jersey State Department of Transportation (NJDOT), or authorized designee to permit said charitable solicitation. After receiving conditional approval from the Mayor and Council, in order to obtain final approval, the applicant shall submit to the Borough Administrator, at least 48 hours in advance of the solicitation, excluding Saturdays, Sundays and holidays, such executed authorization which shall convert the conditional approval to final approval.

i. 
Identify the manner in which the motorist solicitation will be conducted and the procedures to be used to ensure the safety of the members of the public who will be traveling the roadways situate in the Borough of Englewood Cliffs.

Upon filing of a complete application in accordance with the provisions of this Chapter, the Englewood Cliffs Borough Clerk or designee shall present same to the Englewood Cliffs Borough Mayor and Council for its review and consideration, after which the Borough Mayor and Council shall either grant or deny the applicant’s request. In the event the Borough Mayor and Council grants the applicant’s request, the Borough Clerk shall issue a permit to the applicant, which shall be subject to the representations contained in the applicant’s application and any conditions imposed by the Borough Mayor and Council. If the event is to be conducted on a County or State roadway, authorization by the Borough Mayor and Council will be conditioned on the applicant presenting proof to the Borough Administrator that they received permission from the County or State as set forth in Section 16-2g or 16-2h above at least 48 hours, excluding Saturdays, Sundays and Holidays, prior to the event.

In no event shall any charitable organization requesting authorization from the Borough of Englewood Cliffs for said charitable solicitation use any individual under the age of 18 years to perform any function or task associated with the said charitable solicitation in any roadway.

Any charitable organization requesting authorization from the Borough of Englewood Cliffs for said charitable solicitation shall comply with all of the terms and conditions of N.J.S.A. 39:4-60, as amended by P.L. 1997, Chapter 82, approved April 30, 1997.

Any person guilty of violating any provision of this chapter shall be liable for a fine of $100 for each day of such violation. Tickets shall be written by the state, county or local police against N.J.S.A. 39:4-60.
