a. 
In accordance with the rules of the State Department of Health, both contracting parties to a marriage shall appear before the registrar of vital statistics to apply for a license at least 72 hours prior to the time the ceremony is to be performed. Information must be furnished on blanks supplied for that purpose before the license will be issued.
b. 
Every person having authority to solemnize marriages, and the clerk or keeper of the minutes of every religious society before which any marriage shall be solemnized in the borough, shall transmit to the registrar of vital statistics a certificate, in writing, of every marriage within five days after the same shall have been solemnized. The certificate to be made out on blank forms furnished by the registrar for that purpose and shall include all facts required by the forms.

Any physician or midwife present at the birth of any child born in the borough and in case there be no physician or midwife present, then the parent or witness present at the birth shall report in writing, to the borough registrar of vital statistics within five days after the date of the birth all particulars concerning the birth called for on the blank forms furnished by the registrar for that purpose.

When any person dies within the borough, the physician who may have attended the person during his illness shall furnish to the undertaker or any member of the family applying therefor a certificate, in writing, of the death. The certificate shall be made out and shall comprise all the facts stated in the blank forms furnished by the registrar of vital statistics for that purpose.

Cemeteries and burials shall be governed by relevant State statutes and the standards established therein.

It is intended that the terms "license" or "permit" wherever used in this subsection, be synonymous if, in the interpretation of any part hereof, the synonym is required to carry out the manifest intent and purpose of this Code.

All applications for licenses, permits or certificates, shall be made at the office of the board during regular office hours and the fees for every license or permit shall be paid in advance at the time of making the application.[1] All applications shall be accepted only if made on approved application forms obtainable at the office of the board or upon a letter of request if no application form is available.

a. 
The granting of any license, permit or certificate may be withheld, at the direction of the board, pending examination, investigation or inspection of the person who, or the premises which may be the subject matter of the license, permit or certificate under consideration.
b. 
The board shall evidence the granting of any license, permit or certificate issued, by furnishing to the licensee, permittee or certificate holder, a suitable card, sign, placard, disc, plate or other writing which shall convey information concerning the nature of the license, permit or certificate, the serial number of same, name of the person to whom same has been issued, the year in which same is so issued, the premises or vehicle so licensed, if that be material or required, and other information as the board may deem pertinent.

All license permits or certificates issued under any of the several sections of this Code shall be valid from the date issued until January 15, of the following year in which they are issued unless otherwise herein provided. All license renewal shall take effect January 15 of each year and run for a period of one year thereafter.

Every license, permit or certificate issued by the board, shall be displayed in a conspicuous place in the establishment, premises or other place for which the same is issued, and shall likewise be so displayed on every vehicle or conveyance so licensed, for the period that the license, permit or certificate shall be in force, unless the board shall otherwise prescribe.

a. 
Every license, permit or certificate issued may, at any time during the term for which the same is issued, be suspended by the board (or in an emergency, by its health officer), pending a hearing, to be granted the holder, pursuant to a notice to show cause to the board why the license, permit or certificate should not be suspended further or revoked.
b. 
No license, permit or certificate shall be suspended unless the health officer shall file, with the board, a complaint or charges evidencing one or more violations of the section under which the license, permit or certificate was originally issued.
c. 
Every suspension ordered under this subsection shall automatically terminate two weeks from the date thereof, unless the continuance of the suspension shall be ordered by the board, and then the suspension shall continue only during the period of any continuance so ordered by the board.
d. 
During the period of any suspension, or ordered continuance thereof, every license, permit or certificate suspended shall be ineffective and the holder shall, during the entire period of the suspension, cease the operation of any business or discontinue every activity or use permitted under the license, permit or certificate suspended.

a. 
Any license, permit or certificate issued under the provisions of this Code, may be revoked at any time by the board, for just cause, or if licensee, permittee or certificate holder, or any of the employees, agents or servants of the licensee, permittee or certificate holder shall violate:
1. 
Any of the provisions of this Code or any amendments hereof or supplements hereto.
2. 
The Sanitary Code of the State Department of Health specifically applicable to the subject matter for or upon which the license, permit or certificate was issued.
b. 
Before any license, permit or certificate may be revoked, the holder shall be given a hearing and an opportunity to be heard on the complaint made or violation charged against him.

a. 
The time and place for a hearing shall be fixed at the discretion of the board; provided, however, that an unreasonable time shall not be permitted to elapse between the date of any suspension of license and the date fixed for the hearing.
b. 
Notice of the time and place of any hearing held under this section shall be given by the board to the holder of the license, permit or certificate so involved, in writing, and served either personally, or sent to him by registered mail, addressed to him at the address stated in the license, permit or certificate.
c. 
A licensee, permittee or certificate holder who fails to appear at the time and place fixed for the hearing, shall not be entitled to any further hearing and in that event, his license, permit or certificate may be revoked.

The annual fee for the several licenses, permits or certificates referred to in this Code, are hereby fixed as follows:
1. 
Barber Shops, Beauty Salons, Nail Salons and Tanning Salons - health certificate - $50 for each health certificate issued.
2. 
Birth/Death/Marriage - Certified Copies - $10 for each certified copy issued.
3. 
Fat, Bones and Refuse - license to engage in business to remove - $100 for each vehicle licensed.
4. 
Fitness Club, Personal Training Center - license to engage in such business - $25 per facility with five fitness trainers or less. $50 per facility with six to 10 fitness trainers. $75 per facility with over 10 fitness trainers.
5. 
Food Handlers — all employer/employees who handle food are required to have a health certificate - $10 for each health certificate issued.
6. 
Food Vendors, Mobile Food Trucks - license to engage in such business - $100 for each vehicle licensed.
7. 
Food or Beverage Processing - $100 for each premises or establishment licensed and $100 for each vehicle so used.
8. 
Frozen Foods Processing, Sale or Distribution - license required to engage in such business - $100 for each license issued.
9. 
Ice, Manufacture, Sale or Delivery - license required to engage in such business - $30 for each plant, depot, establishment, place, wagon, truck, vehicle or conveyance licensed.
10. 
Marriage - license - $28 for each so couple licensed. (Regulated by N.J.S.A. 37:1-12; 37:1-12.1)
11. 
Massage Operator or Masseur - license required to engage in such business - $75 for each person so licensed. (As per BH18-1 must present diploma and health certificate)
12. 
Milk, Cream and Dairy Products - sale and distribution - license required to engage in such business $50 for each premises or place licensed and $75 for each vehicle or conveyance licensed.
13. 
Nursery School or Child Care Center - license to operate same - $200 for each premises licensed.
14. 
Permanent Cosmetics, Body Art, Tattoos, Body Piercing - $500 for each business licensed. [Must show certification pursuant to N.J.A.C. 8:27-1 et seq.]
15. 
Portable Toilets for Building Sites - required permit of $50 for a six-month period.
16. 
Restaurant, Cafeterias, Delicatessen - license required to engage in such business per establishment if under 50 seating places $150 - if over 50 seating places $300 - if over 100 seating places $500.
(a) 
Temporary 1-7 Day(s) - license required to engage in such business per establishment or vendor for a period of one day to seven days is $50.
(b) 
Permanent catering - $150 to engage in each such business.
17. 
Small Animals, Keeping of:
(a) 
Dogs (Neutered/Spayed) - $10 for each dog.
(b) 
Dogs (NOT Neutered/Spayed) - $15 for each dog.
(1) 
Late Fees - $25 for late assessment from March 1st to April 30th.- $50 for late assessment from May 1st to December 31st.
(c) 
Cats (Fixed) - $10 for each cat.
(d) 
Cats (NOT Fixed) - $15 for each cat.
(1) 
Late Fees - $25 for late assessment from March 1st to April 30th.- $50 for late assessment from May 1st to December 31st.
(e) 
Commercial Purposes (Pet Store) - $150 for each establishment licensed.
(As per BH1-2 of the Board of Health codes)
18. 
Swimming Pool - license to operate as a business or for profit - $400 for each business in operation.
Whirlpool - license to operate as a business or for profit - $400 for each business in operation.
19. 
Vending - license required to engage in business - $25 per each machine.
b. 
Whenever, in this Code, a license or permit is required and no specific fee is established for such license or permit, the fee shall be $2 payable on issuance of the license or permit, which shall be for the balance of the calendar year in which the same is issued.
c. 
Late Fee for Licenses: All license permit or certificate fees established herein shall expire on January 15 of the year next following issue. All license permit or certificate fees required under any of the several sections of this Code shall be paid on or before January 15 of the year of renewal. Should such fees not be paid on or before January 15 of the renewal year, there shall be a late fee imposed of 25% of the yearly license fee.
Should such fees not be paid on or before January 31st of the renewal year, complaint shall be made in the municipal court of the borough or before another judicial officer having authority under the laws of the State of New Jersey. The court shall have the power to impose those penalties established in BH1-5, Penalty.
d. 
Fees for Retail Food Service Establishments and Restaurants Receiving Conditional Ratings. Retail food service establishments and restaurants which require six or more inspections per year as a result of conditional and/or unsatisfactory ratings as provided under the State Sanitary Code or Title 24, N.J.S.A. shall within 30 days of receipt of notice of said inspection pay a reinspection fee of 25% of the yearly license fee applicable for the second conditional and/or unsatisfactory reinspection and every subsequent reinspection required thereafter.
Should such reinspection fee not be paid within 30 days of receipt of written notice complaint shall be made in the municipal court of the borough or before another judicial officer having authority under the laws of the State of New Jersey. The court shall have the power to impose those penalties established in BH1-5, Penalty in addition to all other revocation and suspension rights established by this Code.
e. 
Fees for Swimming Pools Receiving Conditional Ratings: Swimming pools, public or private, which require four or more inspections per year as a result of conditional and/or unsatisfactory ratings as provided under the State Sanitary Code shall within 30 days of receipt of notice of said inspection pay a reinspection fee of 25% of the yearly license fee applicable for the second conditional and/or unsatisfactory reinspection and every subsequent reinspection required thereafter.
Should such reinspection fee not be paid within 30 days of receipt of written notice, complaint shall be made in the municipal court of the borough or before another judicial officer having authority under the law of the State of New Jersey. The court shall have the power to impose those penalties established in BH1-5, Penalty in addition to all other revocation and suspension rights established by this Code.

The fee for certified copies of marriage, death and birth certificates shall be as stated in subsection 2-4.1.

No fee for any permit, license or certificate issued shall be required of any person declared by State law to be exempt from the payment of any fee.

For good reason shown, the board may waive or reduce the license fee in any particular class of cases where the imposition would work hardship or injustice.
