The board of health of the borough has heretofore by an ordinance
adopted May 7, 1962 incorporated by reference into the ordinance of
the board of health of the borough the "Swimming Pool Code of the
State of New Jersey (1955)" and the board of health of the borough
and the mayor and council deem it advisable that the ordinance be
supplemented by an ordinance regulating the location, construction,
alteration, and operation of public swimming pools and the establishing
of license fees and permit fees in connection therewith.
The definitions set forth in Section 1 of the "Swimming Pool
Code of the State of New Jersey (1955)," heretofore adopted under
an ordinance of the board of health of the borough which section sets
forth certain definitions, is hereby incorporated by reference.
No persons shall locate and construct, alter or operate a swimming
pool until a license therefore shall have been issued by the board
of health of the borough.
The following fees and charges are herewith established:
a. For the issuance of a license to locate and construct a swimming
pool - $50.
b. For the issuance of a license to alter a swimming pool - $50.
c. For the issuance or removal of a license to operate a swimming pool
- $150.
Licenses issued for the operation of a swimming pool shall expire
annually on December 31 of each year, and each of the licenses shall
be for one calendar year. Application for renewal of a license shall
be submitted together with the required fee, prior to December 15
of the year prior to the calendar year during which the license is
to be effective.
Licenses required by this chapter may be denied or suspended
by the board of health of the borough for failure on the part of the
license-holder to comply with the "Swimming Pool Code of the State
of New Jersey (1955)" which code was adopted by reference by the board
of health of the borough by an ordinance of May 7, 1962, or for failure
to comply with the sanitary code of the borough.
The board of health shall afford the person whose license to
locate and construct, alter and operate has been denied or suspended,
an opportunity to be heard in the public hearing.
Any person violation any of the provisions of this chapter or of the "Swimming Pool Code of the State of New Jersey (1955)" heretofore referred to shall, upon conviction thereof, be liable to the penalty as established in chapter
3, section
3-1.
