A Length of Service Award Program (LOSAP) is herewith created in accordance with Chapter 388 of the Laws of 1997, as amended (N.J.S.A. 40A:14-183, et seq.), to reward members of the North Wildwood Volunteer Fire Company and the Anglesea Volunteer Fire Company for their diligent and devoted services to the residents of the City of North Wildwood.
The LOSAP shall provide for fixed annual contributions to a deferred income account for each volunteer member that meets the criteria set forth below; that such contributions shall be made in accordance with a plan that shall be established by the City of North Wildwood pursuant to P.L. 1997, c. 388, as amended (N.J.S.A. 40A:l4-183, et seq.); and that such plan shall be administered in accordance with the Laws of the State of New Jersey, the U.S. Internal Revenue Code, and this article.
The LOSAP shall provide for annual contributions to each eligible, active volunteer member of the North Wildwood Volunteer Fire Company and/or the Anglesea Volunteer Fire Company that meets the criteria as follows:
A. 
The number of points required for an active volunteer member of North Wildwood Volunteer Fire Company and/or Anglesea Volunteer Fire Company to be eligible for an annual contribution is 30 points. Points are earned in accordance with the schedule annexed as Schedule A.[1]

B. 
Any active volunteer member of North Wildwood Volunteer Fire Company and/or Anglesea Volunteer Fire Company who obtains 30 or more points shall initially receive $1,150 deferred contribution for his/her active status in said organization. Thereafter, this amount shall be subject to adjustment in accordance with the Consumer Price Index (CPI) pursuant and in accordance with N.J.S.A. 40A:14-185(f) and N.J.A.C. 5:30-14.9.
C. 
No person who is an active volunteer in more than one volunteer emergency services organization governed by this article shall be permitted to receive more than the $1,150 as thereafter adjusted pursuant to Subsection B of this section, total deferred contribution for his/her active status in said organizations.
The LOSAP shall not provide for contributions for prior services by any active volunteer member of the North Wildwood Volunteer Fire Company or the Anglesea Volunteer Fire Company.
The estimated cost of the program has been calculated as follows: for regular annual services, $32,200 for the year 2005.
A. 
This article shall not take effect unless and until it is approved by voters of the City of North Wildwood as a public question at the next general election.
B. 
The following referendum question shall be submitted to the voters of the City of North Wildwood at the November 2, 2004, general election:
"Shall the City of North Wildwood be authorized to establish a Length of Service Awards Program for volunteer fire fighters that are active members of the North Wildwood Volunteer Fire Company and the Anglesea Volunteer Fire Company that serve the City of North Wildwood in accordance with the following terms and conditions:
A.
The program shall provide for annual contributions to a deferred income account for each active volunteer member that meets the eligibility criteria and in accordance with the Schedule adopted by the City of North Wildwood.
B.
The proposed maximum annual contribution for an active volunteer firefighter is $1,150 for the year 2005. Thereafter, that amount shall be subject to adjustment in accordance with the Consumer Price Index (CPI) pursuant to and in accordance with N.J.S.A. 40A:14-185(f) and N.J.A.C. 5:30-14.9.
C.
The estimated cost of the program has been calculated as follows: For regular annual services: $32,200 for the year 2005.
Explanatory statement: The City of North Wildwood has decided to create a Length of Service Awards Program ("LOSAP") for active members of the North Wildwood Volunteer Fire Company and the Anglesea Volunteer Fire Company that serve the citizens of the City of North Wildwood. The general requirements for a LOSAP are set forth in state law (N.J.S.A. 40A:14-183, et seq.). Additional details on the program may be found in the ordinance adopted by the City of North Wildwood, which is available for public inspection, along with a copy of the state enabling law at the City Hall, 901 Atlantic Avenue, North Wildwood, New Jersey, 08260, between 8:00 a.m. and 4:00 p.m., Monday through Friday (legal holidays excluded)."
