Before any work is commenced for the demolition of any buildings in the City of North Wildwood, a permit for said work must be obtained from the Construction Official in accordance with the provisions of the Uniform Construction Code of the State of New Jersey.

The fees to be charged for the issuance of permits for the demolition of buildings shall be in accordance with the Uniform Construction Code of the State of New Jersey as listed at N.J.A.C. 5:23-4.20 and § 200-3 of the Code of the City of North Wildwood.

No permit shall be issued for the demolition of any building while there are any delinquent taxes or municipal charges (including water and sewer charges) against the property upon which the building is situate.

In addition to any other federal, state or local law or regulation that may be applicable, demolition sites also shall be subject to the following:
A. 
All sidewalks on or adjoining the demolition site shall be maintained free of debris and shall be maintained for the safe use thereof by the public.
B. 
All utility service disconnected areas shall be maintained safely, excavations filled and utility lines properly secured.
C. 
All dumpsters and roll-off containers that are to be used in connection with demolition of structures shall be subject to the provisions of Chapter 217 of the Code of the City of North Wildwood, as amended from time to time.

The salvaging and/or removal from structures of exterior or interior elements which, by way of example, but not by way of limitation, include windows, doors, plumbing fixtures, mechanical systems or their components, pipe, wiring, brick, stone, marble, tile, lumber, cabinets, countertops and the like shall be prohibited except during the 72 hours next preceding the commencement of demolition of the subject structure. During that seventy-two-hour period, all first floor points of ingress and egress to the structure must be secured so as to prevent access to the structure by unauthorized individuals.

It shall be unlawful for any owner or person in possession of any lands in the City of North Wildwood to permit such lands to be covered with or contain refuse and debris resulting from demolition of any structure for any period in excess of 15 days.

Any violation hereunder shall be considered an offense punishable by a fine not to exceed $1,250 for each offense, or imprisonment for a term not exceeding 90 days, or both. The following rules shall apply in determining responsibility for violations and penalties:
A. 
The owner of a demolition site where a violation has been committed or does exist shall be guilty of such an offense.
B. 
Any contractor or person who commits, takes part in or assists in such violation shall be guilty of such offense.
C. 
Each day that a violation continues shall constitute a separate offense.
D. 
In the event that the penalties established by this section are inconsistent with the penalty section of any other applicable ordinance contained within the Code of the City of North Wildwood, then the inconsistency shall be resolved in favor of the ordinance providing the more severe penalty except in those cases wherein the penalty is prescribed by state statute.
