As used in this article, the following terms shall have the meanings indicated:
HEREFORD INLET SEAWALL and SEAWALL
Used interchangeably and shall mean the seawall that has been constructed along those bodies of water that commonly are known as "Hereford Inlet" and the "Atlantic Ocean" and along the beach (as "beach" has been defined in § 138-1 of the Code of the City of North Wildwood) and which has its northerly terminus in the vicinity of the real property that is shown on the City of North Wildwood Tax Map as Block 34 and which has its southerly terminus in the vicinity of the real property that is shown on the City of North Wildwood Tax Map as Block 423.
No person shall engage in any of the activities set forth below on the Hereford Inlet Seawall and its appurtenances and approaches:
A. 
Operate or cause to be operated a self-propelled wheeled device such as, by way of example but not by way of limitation, skateboards, bicycles, roller blades, roller skates and scooters. This subsection shall not be interpreted to apply to the use of medically necessary devices, such as wheelchairs and walkers, on the seawall.
B. 
Operate or cause to be operated any motor vehicle or any motorized wheeled device such as, by way of example and not by way of limitation, motorcycles, minibikes, motor scooters, go-carts and electric personal assistive mobility devices (as defined in N.J.S.A. 39:4-14.10). This subsection shall not be interpreted to apply to the use of medically necessary devices such as motorized wheelchairs on the seawall.
C. 
Consume alcoholic beverages.
D. 
Climb upon or stand on any railings, fences, benches or signs.
E. 
Sleep upon the seawall, its appurtenances and approaches or any benches located thereon.
F. 
Hawk, peddle or sell any article, goods, wares, merchandise or services.

Any person convicted of a violation of this article shall, upon conviction thereof, be punishable by a fine not to exceed $2,000, imprisonment for not more than 90 days, or community service for not more than 90 days, or any combination thereof.
