This chapter is promulgated by the Council of
the City of North Wildwood to provide rules, regulations, standards
and procedures for the use and placement of satellite television earth
station dish antennas within the City of North Wildwood and in order
to promote the public health, safety, welfare and aesthetics of this
municipality in accordance therewith.
As used in this chapter, the following terms
shall have the meanings indicated:
SATELLITE TELEVISION EARTH STATION DISH ANTENNA
Any apparatus which is designated for the purpose of receiving
television, radio, microwave, satellite or other similar signals,
with the exception of conventional television antennas. Said definition
shall not include any antenna used for the purpose of the transmission
of signals.
The provisions of this chapter shall be administered
by the Construction Code Official of the City of North Wildwood.
A satellite television earth station, commonly
referred to as a "dish antenna," including any structural supports,
is permitted in all zones after the following requirements have been
met:
A. A dish antenna is only permitted as an accessory use
on a lot that contains a principal structure.
B. Only ground-level, freestanding, ground-mounted dish
antennas shall be permitted.
C. Ground-mounted dish antennas shall be located in the
rear yard only.
D. Power-control and signal cables from the ground-mounted
dish antenna to the served structure shall be buried in accordance
with the appropriate code.
E. No property may contain more than one dish antenna
as heretofore regulated.
F. The dish antenna shall not be located within five
feet of the rear yard or side yard property lines.
G. No form of advertising or identification shall be
placed on the dish antenna other than a label of the manufacturer
and/or installer, which label shall be no larger than 36 square inches.
H. Dish antennas mounted on mobile or trailer-type units
shall not be permitted, except for demonstration purposes only, and,
in that case, said mobile unit shall not be permitted to remain on
any property for more than 48 hours.
I. The dish antenna must be screened from the roadway
and adjoining property owners with foliage of four to five feet in
height at the time of planting and of such density so as to screen
said dish antenna from the road and adjoining property owners during
the entire year.
J. Dish antennas shall not be connected to or placed
upon any roof.
In order for a permit to be issued for the installation
of a dish antenna, in addition to the standard building permit application,
the owner/developer shall also submit for review by the Construction
Code Official of the City of North Wildwood the following:
A. A plot plan containing the following:
(1) The location of all existing structures and the proposed
dish.
(2) The setbacks from lot lines of all existing structures
and the proposed dish.
B. The diameter and height of the dish measured pursuant
to this chapter.
C. Manufacturer's specifications for the installation
of said dish antenna.
Every dish antenna shall only be installed by
a certified dealer or certified representative of the manufacturer
of the dish antenna.
The Construction Code Official of the City of
North Wildwood is hereby designated as the public officer charged
with the enforcement of the terms of this chapter. All complaints
for the alleged violation of any of the terms of this chapter shall
be submitted, in writing, to said Construction Code Official.

Any person who violates any provision of this
chapter shall, for each and every violation thereof and for each and
every day that said violation continues to be in existence, be punishable
by a fine of not more than $2,000, imprisonment for not more than
90 days, or community service for not more than 90 days, or any combination
thereof.
