Pursuant to § 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the Township of Franklin.

The local enforcing agency shall be the Bureau of Fire Prevention of the Township of Franklin, which is hereby created.
The local enforcing agency shall enforce the Uniform Fire Safety Act[1] and the codes and regulations adopted under it in those buildings and structures as are designated in the New Jersey Uniform Fire Code and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency established by § 218-10 of this article shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
A. 
The local enforcing agency established pursuant to § 218-10 of this article shall be deemed a part of the Township of Franklin and shall operate under the supervision of the Township Administrator. Supervision as set forth above shall include but not be limited to the following:
(1) 
Approval of the annual budget of the Bureau of Fire Prevention prior to its submission to the governing body of the Township of Franklin. Such approval shall include approval of all salary requests.
(2) 
Approval of all purchase requests in excess of the sum of $25.
(3) 
Approval of all personnel action.
(4) 
Approval of any request for attendance by the Fire Official at education courses, seminars, or conventions relevant to the duties of Fire Marshal.
(5) 
Establishment of all policy and procedure directly related to the operation of the agency, including the day-to-day performance activities and/or duties of the Fire Marshal.
(6) 
To undertake any other action for the necessary and proper performance of the Bureau of Fire Prevention.
B. 
Such funds as may be necessary to support the operation of this agency shall be appropriated to the Bureau of Fire Prevention of the Township of Franklin each year.
A. 
Appointment of the Fire Marshal. The local enforcing agency shall be under the direct supervision of a Fire Marshal who shall be appointed by the governing body of the Township of Franklin.
B. 
Term of office. The Fire Marshal shall serve for a term of one year. Any vacancy shall be filled for the unexpired term.
C. 
Inspector and employees. Such inspectors and other employees as may be necessary in the Local Enforcing Agency shall be appointed by the governing body of the Township of Franklin upon the recommendation of the Bureau of Fire Prevention of the Township of Franklin.
D. 
Removal from office. Inspectors and other employees of the local enforcing agency shall be subject to removal by the governing body of the Township of Franklin for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
E. 
Reappointment. In the event of a reappointment of the Fire Marshal, the Bureau of Fire Prevention shall submit the Fire Marshal's name to the governing body of the Township of Franklin, recommending the reappointment of said Fire Marshal.
A. 
The local enforcing agency shall inspect all other structures and premises not otherwise classified as a life-hazard use by the Uniform Fire Safety Act. These said structures and premises shall conform to the State of New Jersey Uniform Fire Code and local codes. hi addition, the aforementioned structures and premises shall be inspected at a frequency of not less than every other year.
B. 
The Fire Code Official shall charge an annual fee and issue a permit of inspection for the following use groups:

(1) 
Assembly.
(a) 
Permitted occupancy of fewer than 50 persons: $84.
(b) 
Less than 5,000 square feet: $45.
(2) 
Business.
(a) 
One to two stories, less than 5,000 square feet in area: $35.
(b) 
One to two stories, greater than 5,000 square feet in area: $45.
(c) 
Above two stories, less than 5,000 square feet: $35 per floor.
(d) 
Above two stories, greater than 5,000 square feet: $45 per floor.
(3) 
Factory.
(a) 
Up to 5,000 square feet in area: $45.
(b) 
Five thousand one to 11,999 square feet in area: $70.
(4) 
Mercantile.
(a) 
Less than 5,000 square feet in area: $35.
(b) 
Five thousand square feet in area, but less than 12,000 square feet in area: $45.
(c) 
Above two stories, less than 5,000 square feet: $35 per floor.
(d) 
Above two stories, greater than 5,000 square feet: $45 per floor.
(5) 
Residential.
(a) 
One to 25 rental units: $35.
(b) 
Twenty-six to 50 rental units: $65.
(c) 
Fifty to 75 rental units: $120.
(d) 
Seventy-six to 100 rental units: $170.
(e) 
One hundred fifty-one or more rental units: $220.
(6) 
Storage.
(a) 
Less than 5,000 square feet of storage area: $35.
(b) 
Five thousand square feet, but less than 12,000 square feet of storage area: $45.
(7) 
Utilities.
(a) 
Less than 5,000 square feet: $35.
(b) 
Five thousand square feet, but less than 12,000 square feet: $45.
(8) 
Agricultural buildings.
(a) 
Less than 5,000 square feet: $35.
(b) 
Five thousand square feet, but less than 12,000 square feet: $45.
(c) 
Greater than 12,000 square feet: $65.
Permit fees established by the Bureau of Fire Prevention in the Township of Franklin for special activities and operations shall be enforced and adhere to the fee schedule as outlined in the New Jersey Uniform Fire Code, N.J.A.C. 5:70-2.9(c).
Technical amendments to the Code may be passed by amendments to this article, but such technical amendments must not be less than the minimum requirements established by the New Jersey Uniform Fire Code.
All nonprofit organization shall be exempt from paying permit fees as long as these structures are not rented out to the general public for its use.
