The Carteret Economic Development Corporation shall be designated as the "Zone Development Corporation" for the Borough of Carteret.[1]

Editor's Note: By Ord. No. 95-6, adopted 2-2-1995, the governing body of the Borough accepted the Urban Enterprise Zone Authority designation of the Borough of Carteret as an urban enterprise zone and approved the zone development plan. By Ord. No. 96-13, adopted 6-6-1996, the governing body of the Borough amended and revised the Urban Enterprise Zone within the Landfill Reclamation Improvement District. By Ord. No. 14-16, adopted 12-18-2014, the governing body of the Borough amended and revised the Urban Enterprise Zone to include certain privately owned parcels of commercial real property that were previously owned by the Borough. A copy of Schedule A is on file in the Borough offices.

A. 
The Board of Trustees shall be composed of seven regular members who, except as provided for herein, shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of four years. Only regular members shall be authorized to vote upon matters requiring formal action by the Board.
(1) 
The regular members shall consist of the following:
(a) 
The Mayor.
(b) 
One member of the Borough Council appointed annually by the Council.
(c) 
One other Borough official, officer or employee.
(d) 
Four residents of the Borough and/or members of the business community thereof, who shall be appointed so as to ensure that the total membership of the Board shall be broadly representative of businesses and communities within the Borough.
(2) 
The initial appointments of the resident/business members to the Board of Trustees as reconstituted pursuant to this Ordinance shall be as follows:
(a) 
One person shall be appointed for one year.
(b) 
One person shall be appointed for two years.
(c) 
One person shall be appointed for three years.
(d) 
One person shall be appointed for four years.
B. 
Advisory members.
(1) 
In addition to the regular members, the Board of Trustees shall have 12 advisory members who shall not have a vote on matters requiring formal action by the Board. Advisory members shall be residents of the Borough and/or members of the business community thereof, and shall, collectively, be broadly representative of the businesses and community organizations within the Borough. Advisory members shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of four years.
(2) 
The initial appointments of the advisory members to the Board of Trustees as reconstituted pursuant to this ordinance shall be as follows:
(a) 
Three members shall be appointed for one year.
(b) 
Three members shall be appointed for two years.
(c) 
Three members shall be appointed for three years.
(d) 
Three members shall be appointed for four years.
C. 
All members of the Board of Trustees shall serve on a non-salaried basis.

Editor's Note: This ordinance was vetoed by the Mayor 12-13-2001, which veto was overridden 12-13-2001. This ordinance provided that the Board of Trustees as reconfigured pursuant to this ordinance shall be established effective 1-1-2002, with the terms of present members of the Board and the Zone Development Officer expiring on 12-31-2001. Said individuals shall continue in office until their successors have been appointed and qualified.
A. 
The Board of Trustees shall, at a minimum, hold regularly scheduled monthly meetings.

B. 
The Zone Development Corporation shall provide the Borough of Carteret (through the Board of Trustees) with all plans and proposals under review by the Zone Development Corporation prior to any submissions of the same to any federal, state or municipal agency.

It shall be the responsibility of the Zone Development Officer, who shall be appointed annually by the Mayor with the advice and consent of the Borough Council, with review by and comments of the Board of Trustees, to ensure that all provisions of the Urban Enterprise Zones Act (N.J.S.A. 52:27H-60 et seq.) are adhered to during the life of a zone designation.
