The purpose of this chapter is to establish responsibilities of the Police and Fire Department and owners and operators of automated (either physically, electronically or mechanically) burglar alarms and fire alarms in the Borough of Carteret.
As used in this chapter, the following terms shall have the meanings indicated:
ALARM
The activation or call for police or fire assistance by either electronic, mechanical or physical means, via the telephone system or any alarm system connected to the central alarm console maintained at police headquarters or fire headquarters.
FALSE ALARM
Any alarm activated by other than an intruder or malfunction of the alarm console maintained by the borough; or, in the case of a fire alarm, any alarm activated by other than a fire or the report of an actual fire or pressure drops that cause alarms to be activated or by malfunction of the console maintained by the borough, which subsequently is determined false or erroneous.

A. 
It shall be the duty of the owner or his agent to respond to any alarm activation by his system and to secure the alarm and property. The owner or his agent must, within 10 days of receiving a certificate of occupancy, notify the Police Department of said ownership and supply said Department with the name, address and emergency phone number of the person whose responsibility it is to respond to alarms and secure the property.
B. 
The owner or his agent shall, within seven days, notify the Police Department of any change of information for the person charged with the aforementioned responsibility.
It shall be the responsibility of the Police and/or Fire Department to notify the owner of an alarm activated and to keep a record thereof.

A. 
It shall be the duty and responsibility of the owner or his agent to maintain, repair, improve and/or modify the alarm system in his building to prevent false alarms.
B. 
If two false alarms are received from the same building in the same calendar year, it shall be deemed that the system is in disrepair and the owner is in violation of this chapter.

A. 
Alarms activated by a malfunction of the telephone system, by power outages or by any act of God shall not be considered false alarms.
B. 
The provisions of this chapter shall not apply to residential dwellings.

It shall be the responsibility of the owner or his agents to ensure that persons occupying his property comply with this section, and it shall not be deemed to be a valid defense were assumed or give to persons occupying said property.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalties set forth in § 1-17 of this Code. It shall be the responsibility of the Police and/or Fire Department to enforce the provisions of this chapter.
