The purpose of this chapter is to regulate all games of chance held, operated or conducted within the borough pursuant to the Acts of the Legislature of the State of New Jersey known as the "Bingo Licensing Law" and the "Raffles Licensing Law"[1] and in accordance with the rules and regulations issued or to be promulgated by the Legalized Games of Chance Control Commission in the Department of State of the State of New Jersey. All applications, licenses and proceedings in connection therewith shall be subject to the provisions of the Acts and the rules and regulations and any laws, rules and regulations hereafter enacted and shall be further subject to the provisions of this chapter.

A. 
Hours. No licensee authorized by law shall hold, operate or conduct any game of chance at the place where the game of chance is being conducted under any license except between the hours of 1:00 p.m. and 11:00 p.m.
B. 
Special police. All games of chance at which the general public may obtain admission shall be attended by two special police officers of the borough, whose duty it shall be to preserve order. Special police officers shall be paid by the person conducting the game and shall be selected by the Chief of Police. Each officer shall be entitled to compensation from the licensee in an amount prescribed by the Borough Council.
C. 
Organizations eligible for license. No license to conduct a game of chance as authorized by law shall be issued to any organization not having a bona fide status established in good faith within the State of New Jersey and actively engaged in serving one or more of the authorized purposes as defined by the rules and regulations of the Legalized Games of Chance Control Commission.
D. 
Games of chance during elections prohibited. No game of chance shall be conducted under any license at any time during which a general, municipal, primary, special or Board of Education election is being held, while the polls are open for voting.
E. 
Licenses to conduct instant raffles. Licenses to conduct instant raffles, as the same is defined by applicable state statute and regulations, may be granted to qualified applicants for a period of not more than one year from the date of issuance. The issuance fee for each such license, including each renewal, shall be $100, which shall be paid in advance of the issuance or any renewal of any license.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalties set forth in § 1-17 of this Code.

A. 
License fees for bingo. The license fees for bingo shall be $10 for each occasion upon which any game or games are to be conducted under such license.
B. 
License fees for raffles.
(1) 
The license fees for raffles for cash (50/50) or for merchandise (exceeding $400 total prize value) shall be $10 for each day upon which a raffle is held with respect to which all tickets or rights to participate are sold only to persons present at the time of the drawing or allotment of prizes, and $10 for each $1,000 of the value of prizes (merchandise or cash) awarded in each raffle with respect to which tickets or rights to participate may be sold in advance of the occasion or the drawing or allotment of prizes.
(2) 
There shall be no licensing fee for a raffle for cash (50/50) or merchandise which does not exceed $400 in total prize value.
C. 
Carnival games or wheel. The license fees for carnival games or wheels shall be $10 for each game or wheel held on any one day, or any series of consecutive days not exceeding six days at one location.
D. 
Special door prize raffle. There shall be no licensing fee for special door prize raffles, provided the merchandise is wholly donated and has a retail value of less than $50.
E. 
Calendar raffle. The license fees for calendar raffles shall be $10 for each $1,000 of the value of the retail value of the ancillary prizes awarded.
F. 
Instant raffle. The license fee for golf hole-in-one shall be $10 for each $1,000 of the value of the retail value of the ancillary prizes awarded.
G. 
Armchair race. The license fee for armchair races shall be $50 per day of operation.
H. 
Casino nights. The license fee for casino nights shall be $100 per occasion.
