The Borough Council finds that citizens of the
municipality often park roll-off containers, dumpsters or other containers
in the public roadways and/or sidewalks, thereby obstructing pedestrian
and vehicular traffic and causing an unsafe and hazardous condition
detrimental to the welfare and safety of the citizens of our Borough.
The provisions of this article are necessary to protect the safety
of people and property in the Borough.

A. Any person who wishes to park, stop or permit a roll-off
container, dumpster, or other container on any public street or sidewalk,
or on any private property, must first obtain a permit therefor from
the Zoning Office. The fee for said permit shall be $15 for the first
60 days. An additional fee of $10 shall be paid for a thirty-day extension
of the permit. The roll-off container, dumpster or other container
must be removed from site at the end of this period, unless otherwise
approved by the Zoning Office, in its sole discretion, and the payment
of a new permit fee.
B. Any person who wishes to park, stop or permit a roll-off
container to remain on a public street must first notify the appropriate
police officer in charge of the Traffic Division for the Carteret
Police Department. Such notification must take place at least 24 hours
prior to the location of the roll-off container, dumpster or other
container to enable the Police Department to inspect the location
and to make sure of the location and installation of flashing devices
on that particular container.
No person shall park, leave or station a roll-off
container or other container on any public street or part thereof
between the hours of 6:00 p.m. and 7:00 a.m. without installing a
working flashing signal to the roll-off container. Said flashing signal
shall be visible to the public and any vehicles traveling in either
direction on the public roadways.

Any person found to have violated this article shall, upon conviction thereof, be subject to the penalties set forth in §
1-17 of this Code.
