If a member dies prior to actual retirement but after having met the age and service requirements for normal or early retirement benefits, 50% of the benefit the member would have received had he been retired on his date of death will be continued to his surviving spouse while she remains unremarried. Benefits will commence on the first day of the month coincident with or next following the member's date of death. In addition, if the member died on other than the first day of the month, a partial payment will be paid for the member's month of death equal to a full month's benefit multiplied by the ratio of the number of days in the month, including and following the member's date of death, to the full number of days in the month.
If a member dies after having terminated employment with the Borough with entitlement to deferred vested benefits under Article VI but before such benefits have commenced, 50% of the benefit the member was scheduled to receive will be paid to his surviving spouse while she remains unremarried, with benefits commencing on the member's scheduled benefit commencement date. (See § 31-21.)
If there is no eligible unremarried spouse to receive survivor benefits as described in §§ 31-25, 31-26 and 31-28, each child of the member, while such child is under age 18, shall equally share the benefits otherwise payable to an eligible spouse with any other children of the member who are also under age 18.
Survivor benefits, if any, will be payable in accordance with the form of payment under which the deceased member had been receiving benefits.
