As used in this article, the following terms
shall have the meanings indicated:
ASHES
Ashes from coal or other fuel. The term includes such floor
sweepings as may accumulate in connection with the ordinary conduct
of dwellings and buildings, except buildings using steam boilers for
power, but not such as may accumulate as the result of building operations.
GARBAGE
All animal and vegetable waste, including offal, carcasses,
fat, bone, swill and vegetable and animal refuse resulting from the
storage, handling, preparation and consumption of food. It shall not
contain glass, china, metal, disinfectants, sprays, antiseptics or
other foreign matters injurious to hogs.
RUBBISH
All rubbish from places of residence and a reasonable amount
from store buildings. The term includes bottles, paper, rags, mattresses,
worn-out furniture, old clothes, old shoes, leather, carpets, broken
glass, crockery, tin cans, metals, rubber, wallpaper, discarded Christmas
trees and greens, small branches from shrubs, vines, cut grass and
leaves, but does not include any material whatever in the nature of
earth, sand, lumber, brick, stone, plaster or other substance that
may accumulate as the result of building operations, nor will it include
dead animals or night soil.
It shall be the duty of the Board of Health
and the Police Department to assist Council in enforcing the terms
of this article in securing compliance with the requirements hereof.
Any person violating any of the provisions of
this article shall, upon conviction thereof before a District Justice,
be subject to the following penalties:
A. First offense: fine of $5 and costs or five days in
county jail.
B. Second offense: fine of $10 and costs or 10 days in
county jail.
C. Third offense: fine of $20 and costs or 30 days in
county jail.
