The Borough of Glenolden hereby permits and allows the installation and maintenance of bench advertising signs within the Borough of Glenolden upon the terms and conditions set forth hereinafter solely for the purpose of providing a convenience to those persons waiting to board public transportation vehicles.

No person shall install any bench advertising sign within the Borough of Glenolden unless said person obtains a permit for the installation of each bench advertising sign from the Building Inspector of the Borough of Glenolden as provided in § 138-24 of this article and complies with all of the applicable terms and conditions of this article relative thereto. Any permit obtained as provided herein shall also include the right to maintain such bench advertising sign until January 31 of the following calendar year, and if a bench advertising sign is to be maintained thereafter, an annual permit for the maintenance of each bench advertising sign shall be obtained as provided in § 138-24.2 of this article.

In order to obtain a permit for the installation of a bench advertising sign within the Borough of Glenolden, a person must submit to the Building Inspector of the Borough of Glenolden, for each bench advertising sign to be installed, a completed and properly executed application on a form approved by the Council of the Borough of Glenolden and must also submit with said application the following:
A. 
A letter signed by the owner or owners of the property upon which the bench advertising sign is to be installed and initially maintained granting permission for the installation and initial maintenance of the same until January 31 of the following calendar year.
B. 
A permit fee in the sum of $50 for each bench advertising sign to be installed and initially maintained.
C. 
An insurance certificate(s) or policy(ies) for the bench advertising sign evidencing insurance policy coverage therefor until at least January 31 of the following calendar year for general liability in the minimum amount of $250,000 and for property damage in the minimum amount of $25,000. The foregoing insurance policy coverages shall include the Borough of Glenolden as an additional insured.
D. 
A detailed drawing showing all dimensions of the bench, all advertising to be placed on the bench and the specifications of all materials to be used in the construction of the bench.

No person, subsequent to January 31 of the year following the installation of any bench advertising sign, shall maintain any such bench within the Borough of Glenolden unless said person obtains an annual permit for the maintenance of such bench advertising sign from the Building Inspector of the Borough of Glenolden as provided hereinafter and complies with all of the applicable terms and conditions of this article relative thereto. An annual permit for the maintenance of a bench advertising sign shall be for the period beginning February 1 of the current calendar year to January 31 of the following calendar year.

In order to obtain an annual permit for the maintenance of a bench advertising sign within the Borough of Glenolden, a person must submit to the Building Inspector of the Borough of Glenolden, in January of each calendar year, a completed and properly executed application on a form approved by the Council of the Borough of Glenolden and must also submit with said application the following:

A letter signed by the owner or owners of the property upon which the bench advertising sign is to be maintained granting permission for the maintenance of the same until January 31 of the following calendar year.
B. 
A permit fee in the sum of $50 for each bench advertising sign to be maintained.
C. 
An insurance certificate(s) or policy(ies) for the bench advertising sign evidencing insurance policy coverage therefor until at least January 31 of the following calendar year for general liability in the minimum amount of $250,000 and for property damage in the minimum amount of $25,000. The foregoing insurance policy coverages shall include the Borough of Glenolden as an additional insured.
Bench advertising signs shall only be installed and maintained at established locations where public transportation vehicles stop to discharge and take on passengers, and no bench advertising sign shall be installed and maintained more than 25 feet from any established location.
No more than two bench advertising signs shall be installed and maintained at any established location as aforesaid.
All bench advertising signs for which a permit is used shall be stenciled with a permit number by the Borough of Glenolden.
The permittee of any permit for the installation and maintenance of a bench advertising sign may change that portion of the bench showing the name of the business or person advertising without being required to obtain another permit or to pay an additional fee; however, all such changes must be submitted to the Borough of Glenolden in writing. All such changes shall be made at the location of said bench.
If any bench advertising sign must have the permit number restenciled thereon for any reason, the permittee shall pay to the Borough of Glenolden a fee of $10.
The permittee of any approved bench advertising sign is solely liable for the maintenance of said bench.
A. 
If any bench advertising sign is installed and maintained in violation of the provisions of this article or if any bench advertising sign is maintained in an unclean and/or unsafe condition, the Building Inspector shall have said bench removed to a location designated by the Borough Council of the Borough of Glenolden.
B. 
Before any permittee of any bench so removed can reclaim said bench, the permittee must pay to the Borough of Glenolden the sum of $50 to cover the expenses of removing the bench.
If any bench advertising sign is removed from any established location for any reason, any existing permit shall be revoked and said space shall be available for any person to apply for a permit to install and maintain another bench thereon.
Any person who shall violate any provision of this article shall, upon conviction before any District Justice, be punished by a fine of not more than $300 or, in default thereof, by imprisonment for not more than 30 days. Each day's failure to comply with any provision of this article as aforesaid shall constitute a separate violation.
