For the purposes of Part 2 of this chapter, the meanings of certain terms shall be as follows:
BUILDING CONNECTION
The extension from the building drain to the building sewer at the property line, including the actual connection to the building sewer.
COMMERCIAL AND OTHER NONRESIDENTIAL PROPERTY
Any property or structure or unit within a structure, other than residential property, from which sanitary sewage originates and in which water meters are installed indicating the amount of water consumed by occupants thereof.
DWELLING UNIT
Separate living quarters for a person or family within any structure other than a one-family dwelling.
SEWAGE
A combination of the water-carried wastes and such ground-, surface and stormwaters as may be advertently present.
There is hereby established a sewer service charge for the use, operation and maintenance of the sewer system of the Township of Wyckoff, and such charge is hereby levied upon the owners of properties connecting to the sewer system.

A. 
The sewer service charge hereby established for 2023 shall be sufficient to:
(1) 
Cover all the charges, costs and expenses related to the sewer service, such as, but not limited to, the charges of the Northwest Bergen County Utility Authority, the charges of the Boroughs of Midland Park and Waldwick, pump stations and ejector station operation and maintenance costs, and all the costs incurred by the Township of Wyckoff in collecting its sewer service charges; and
(2) 
Create a reasonable reserve for maintenance and repairs.
B. 
The sewer service charge shall be an annual charge commencing upon the date upon which a building connection is approved by the Township, and such charge shall be on the following basis and this rate shall stay in effect until subsequently modified by ordinance amendment:

The use charges established and levied by Part 2 of this chapter shall be due and payable semiannually in accordance with the billing policy established by the Township Committee. Charges for such period or any part thereof shall be based upon a pro rata portion of the annual charge set forth in this Part 2 or based upon gallonage where the charge covers annual sewage flow of 100,000 gallons or more.

Where the charge set forth in Part 2 of this chapter is based upon the quantity of sewage flow, such quantity shall be determined to be the quantity of water used on the premises based upon water consumption records of the Village of Ridgewood Water Department covering the previous six-month period as evidenced by the previous water bills. However, where the owner of commercial or nonresidential property can clearly show that water used on the premises was not discharged into the sewer system, such fact shall be taken into account when determining the quantity of discharge into the sewer system.
Anything herein to the contrary notwithstanding, where any special or additional charge is made, levied or assessed by the Northwest Bergen County Sewer Authority as a result of the special nature of sewage, such special or additional charge may be added to the charge set forth above in this Part 2. Nothing herein shall preclude the Northwest Bergen County Sewer Authority from charging directly for special sewage.

The sewer service charges established by this Part 2 shall draw delinquent interest at the rate of 8% for balances up to $1,500 and 18% for balances exceeding $1,500 and shall be a lien upon the premises connected until paid. One-half of the sewer service charge will be due in the office of the Tax Collector on May 1 of the current year, for the first half; the second half payment will be due on August 1 of the current year. Delinquent interest is to be calculated on the sum of all delinquent sewer service charges from year to year and is not to be calculated on an individual year basis. At the end of any calendar year a penalty of 6% may be charged where there is tax and or any other municipal charge delinquency in excess of $10,000. The Township of Wyckoff shall have the same remedies for the collection of sewer service charges with delinquent interest, cost and penalties as it has by law for collection of taxes upon real estate.
