[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code of Mercer County has been amended to delete the term “Board of Chosen Freeholders” and replace it with the term “Board of County Commissioners.” In addition, the terms “Freeholder” and “Chosen Freeholder” have been deleted and replaced by the term “County Commissioner.”]
In accordance with the Solid Waste Management Act (Chapter 326, P.L. 1975),[1] there is created the Advisory Solid Waste Council.

A. 
The Advisory Solid Waste Council shall consist of nine members. The composition and membership of such Council shall be designated by the County Executive with the advice and consent of the Board of County Commissioners.
B. 
The Council shall include at least one municipal Mayor or their designee, a person engaged in the collection or disposal of solid waste and an environmentalist.
C. 
The term of the members shall be for three years, except for the initial term, which shall be as follows:
(1) 
Three members appointed for one year;
(2) 
Three members appointed for two years;
(3) 
Three members appointed for three years.
D. 
Thereafter, all terms shall be for three years. Each person shall serve until the appointment and qualification of their successor.

A. 
The Advisory Solid Waste Council shall assist in the development and formulation of the solid waste management plan. The comprehensive solid waste management plan shall emphasize recycling and resource recovery, shall cover a ten-year period and shall be reviewed every two years.
B. 
The County Executive or his designee shall consult with the Advisory Solid Waste Council at such stages in the development and formulation of the solid waste management plan as deemed necessary. The solid waste management plan shall be adopted only after consultation with the Advisory Solid Waste Council.
C. 
The Advisory Solid Waste Council shall give advice concerning the field of environmental marketing and development.
Any vacancy shall be filled in the manner of the original appointment for the remainder of the unexpired term.
Within 10 days after the appointment of members, the County Executive shall select a Member-Chairperson who shall call the first Council meeting. Thereafter, the Council shall meet monthly or as otherwise deemed necessary by the Chairperson.
