[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code
of Mercer County has been amended to delete the term “Board
of Chosen Freeholders” and replace it with the term “Board
of County Commissioners.” In addition, the terms “Freeholder”
and “Chosen Freeholder” have been deleted and replaced
by the term “County Commissioner.”]

A. The Board shall consist of the County Superintendent of Schools and
six other County citizens who shall have been residents of the County
for at least two years immediately preceding, and shall have shown
an interest in children with an unusual disability to learn or in
the field of mental health. Of the six appointed members, one member
shall be a parent of a handicapped student in the County who attends
schools of the Mercer County Special Services School District on the
date of their appointment to the Board. The Chairperson of the County
Mental Health Board, in accordance with N.J.S.A. 18A:46-35, shall
serve ex officio but shall not be entitled to vote.
B. Citizen members shall serve for three years each from May 1 and until
the appointment and qualification of their successors. The first appointments
under this section shall designate one person to serve for one year,
two for two years, and two for three years. The initial members shall
serve from the time of their appointments, but the term of office
shall be deemed to commence on May 1 of the calendar year in which
they are appointed.
Any vacancy shall be filled in the manner of the original appointment
for the remainder of the unexpired term.
The Board shall organize annually on June 1 by the election
of a President and Vice President, unless June 1 falls on a Sunday,
in which case, the Board shall organize on the following day.
