[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code
of Mercer County has been amended to delete the term “Board
of Chosen Freeholders” and replace it with the term “Board
of County Commissioners.” In addition, the terms “Freeholder”
and “Chosen Freeholder” have been deleted and replaced
by the term “County Commissioner.”]
As used in this chapter, the following terms shall have the
meanings indicated:
A. No person or persons shall place any materials in any gutters or
drainage structures along County roads resulting in any stoppage of
drainage along such roads.
B. No person or persons shall damage any County road or County road
surface by spilling or throwing stones, dirt, oil or other harmful
materials thereon.
C. No person or persons shall divert surface or other waters to County
roads or pump any water to County roads or do any acts upon properties
abutting County roads resulting in the spillage of water from such
properties to County roads.
D. No person or persons shall during any snow removal operation dump
or push snow onto a County road that in any way could result in damage
to such road.
Any person or persons violating any of the provisions of this
chapter shall be subject to a fine in an amount not exceeding $500
or imprisonment in County jail for a period not exceeding 90 days,
or both. The court, before which any person is convicted of violating
this chapter, shall have power to impose any fine or term of imprisonment
not exceeding the maximum fixed in this section. Any person convicted
of a violation of this chapter may, in the discretion of the court
by which he was convicted, and in default of any payment of any fine
imposed thereof, be imprisoned in the County jail for a term not exceeding
90 days for such default.
Jurisdiction to enforce the provisions of this chapter shall
be in the municipal court in the municipality where the violation
occurs.
