[HISTORY: Adopted by the Board of Chosen Freeholders of Mercer County 4-25-2006 by Ord. No. 2006-3. Amendments noted where applicable.]
[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code of Mercer County has been amended to delete the term “Board of Chosen Freeholders” and replace it with the term “Board of County Commissioners.” In addition, the terms “Freeholder” and “Chosen Freeholder” have been deleted and replaced by the term “County Commissioner.”]
There is hereby established within the County of Mercer a "Mercer County Voting Accessibility Advisory Committee."
The Mercer County Voting Accessibility Advisory Committee shall consist of at least seven, and not more than 11, members as follows:
A. 
The four members of the County Board of Elections.
B. 
Three or more public members, to be appointed by the County Executive or County governing body as follows:
(1) 
A representative of the County Executive or a member of the County governing body, as appropriate.
(2) 
At least one elderly and handicapped individual with a disability representing one or more organizations of such individuals.
C. 
At least one individual trained in the provisions of the The Americans with Disabilities Act of 1990 (42 U.S.C. § 12102 et seq.).
D. 
If the County Executive or governing body so elects, any other person deemed able by the Executive or governing body to be of assistance in the implementation of the Act.
In order to accurately evaluate the accessibility of all polling locations, the Voting Accessibility Advisory Committee shall undertake a physical inspection of each polling place in the County. The results shall be used in completing the list of any polling places found inaccessible, pursuant to Section 4 of P.L. 1991, c.429 (N.J.S.A. 19:8-3.4).
The Committee shall receive notice of complaints filed from its County with the Division of Elections in the Department of Law and Public Safety pursuant to Section 6 of P.L. 2004, c.88 (N.J.S.A. 19:61-6) that concern the accessibility of polling places to individuals with disabilities and the elderly.
Any vacancy shall be filled in the manner of the original appointment of members for the remainder of the unexpired term.
Within 20 days after the first appointment of members and thereafter annually, the Advisory Committee shall elect a chairperson, a vice chairperson and a secretary.
