The Select Board Members of the Town shall act as the Cemetery Committee.

The Select Board Members shall be responsible for the care and management of the grounds, buildings, structures, ornamentation, fences and edifices which constitute the Town cemetery. They shall see that this chapter and any rules and regulations which are and may be established from time to time are observed and kept.

The Select Board Members shall, on or before January 1 of each year, render a report in writing to the Town on the management of the cemetery, with any recommendations. This report shall be published in the annual town report.

The Select Board Members shall, annually in May, appoint a Burial Agent of the public cemetery whose term of office shall begin June 1 of the year. The Select Board Members shall, upon due hearing, have the right to remove the Burial Agent.
Such portions of the grounds of the public cemetery shall, as the need arises from time to time, be divided into grave lots or tomb lots or other suitable subdivisions, with proper avenues and paths, and all such divisions shall be numbered in their order.
A. 
The Select Board Members shall sell to every permanent resident of the Town of Hull making a request therefor rights of burial in graves, lots or tombs, in time of need, in so far as the same may be available for sale.[1]

B. 
No rights of burial shall be sold to any person unless the Select Board Members are satisfied that such person intends to remain a permanent resident of the Town.

C. 
Hereafter, the word "permanent" shall, in addition to its usual meaning shall also include those persons who were then not resident in Hull but had been resident for a continuous period of time of seven or more years and had relocated to an adult living community, to an assisted-living facility, a nursing home or to the home of a child or sister or brother.

Such rights of burial granted by the Select Board Members shall not be assignable by any holder thereof, but may be released to the Town.

No burial, disinterment or removal of a body, ashes or remains shall be made except with the consent of the Select Board Members and under the supervision of the Burial Agent. The Select Board Members may, upon the sale of lots as herein provided, by deed made and executed in the form and manner prescribed, convey to the purchaser the sole and exclusive right of burial in any lot in said cemetery and of erecting monuments, tombstones and other structures thereon not inconsistent with this chapter or with any rules or regulations as made by said Select Board Members.

The Select Board Members shall fix the prices of all lots and graves.

The Select Board Members shall cause a careful record to be kept of every interment with the name and age of the person interred, the date thereof, the lot number and the owner of burial rights therein. A duplicate record shall be retained in the Town Treasurer's office for public inspection.
A. 
No person shall walk upon any of the lots and borders within the cemetery, except in conformity with rules established by the Select Board Members, and no person shall gather any flowers or break any shrub or plant or write upon or otherwise damage any monument, fence or other structure in or belonging to the cemetery or discharge any firearms therein, except in the case of military funerals.

B. 
Any person violating any provisions of this section shall be punished by a fine not exceeding $50 for each offense.

Each funeral procession shall be led into the cemetery by the most convenient avenues and shall in no case trespass on other graves, lots or land without the consent of the Select Board Members.

A. 
No owner of burial rights in graves or lots shall in any case alter the natural grades of the avenues and paths adjoining his grave or lot without the consent of said Select Board Members and, in case any trespass of this or a similar kind is committed, the Select Board Members shall cause the same to be removed or restored at the expense of the trespasser.
B. 
No trees, plantings, fences, curbs or other structures shall be erected or allowed to stand upon any grave or lot without the consent of the Select Board Members.

The Select Board Members shall have the power to make from time to time such rules and regulations for the management of public cemeteries as it may deem best, but no rule or regulation shall be made which shall conflict with this chapter.
