The Planning Board established pursuant to N.J.S.A. 40:55-1 et seq. is assigned for administrative purposes to the Department of Planning and Development.[1]

The Board of Library Trustees established by referendum pursuant to N.J.S.A. 40:54-1 et seq. is continued and assigned for pertinent administrative purposes to the Office of the Mayor.
The Board of Health established pursuant to N.J.S.A. 26:3-1 et seq. is continued, provided that its administrative functions shall be exercised by the Department of Community Services and its legislative functions by the City Council.
The Local Assistance Board pursuant to N.J.S.A. 44:8-115 is continued, with jurisdiction over appeals from administrative decisions, and is assigned for administrative purposes to the Department of Community Services.
The Housing Authority created pursuant to N.J.S.A. 55:14A-49 et seq. is continued and assigned for administrative purposes to the Office of the Mayor.
A. 
There is hereby created a Rent Leveling Board within the City of Orange Township. Said Board shall consist of seven (7) members. The members of said Board shall be appointed by the governing body, and their terms of office shall be for a period of two (2) years, with each member serving without compensation.
B. 
The Rent Leveling Board is hereby granted and shall have and exercise, in addition to other powers herein granted, all the powers necessary and appropriate to carry out and execute the purposes of this section, including but not limited to the following:
(1) 
To issue and promulgate such rules and regulations as it deems necessary to implement the purposes of this section, which rules and regulations shall have the force of law until revised, repealed or amended from time to time by the Board in the exercise of its discretion, provided that such rules are approved by the City Council and filed with the Municipal Clerk.
(2) 
To supply information and assistance to landlords and tenants to help them comply with the provisions of this section.
(3) 
To hold hearings and adjudicate applications from landlords for additional rental as hereinafter provided.
C. 
For administrative purposes, the Rent Leveling Board is assigned to the Department of Planning and Development.
An Alcoholic Beverage Control Board is continued pursuant to N.J.S.A. 33:1-5 et seq. and shall be constituted and appointed as provided therein and in Section 43(e) of the Optional Municipal Charter Law.
The Board of Building Code Appeals is continued and assigned for administrative purposes to the Department of Planning and Development.
A. 
It is hereby established that the Orange Multiple Dwelling Emergency Board, hereinafter referred to as the "Board," shall consist of seven (7) members. The membership of the Board shall consist of the Health Officer, the Public Officer and seven (7) members of the Orange Rent Leveling Board.
B. 
The duties of the Board shall consist of the following:
(1) 
Receiving, administering, expending and accounting for security funds deposited pursuant to the terms of Chapter 173, Security Funds for Multiple Dwellings.
(2) 
Examining the circumstances and conditions alleged to constitute emergency conditions and declaring, where applicable, an emergency condition to exist.
(3) 
Arranging, in accordance with the terms of Chapter 173, Security Funds for Multiple Dwellings, for the prompt repair, maintenance, supply or replacement of those items of structure, equipment or supplies which are necessary to correct, eliminate or alleviate the emergency condition.
C. 
The Multiple Dwelling Emergency Board shall be assigned for administrative purposes to the Department of Planning and Development.

A. 
Establishment. An Open Space, Recreation and Historic Preservation Advisory Committee is hereby established to be known as "The Orange Open Space, Recreation and Historic Preservation Advisory Board." The word "Board," when used in this section, refers to the Orange Open Space, Recreation and Historic Preservation Advisory Board.
B. 
Composition; compensation.
(1) 
The Board shall consist of 15 members, seven of which will be City of Orange Township residents appointed by each member of the City Council, as follows:

(a) 
Director of Planning and Development;
(b) 
City Council Chair;
(c) 
Mayor or his/her designee;
(d) 
Director of Department of Community Services or his/her disignee;
(e) 
City Administrator;
(f) 
One member of the Planning Board;
(g) 
Representative from Historic Preservation Commission;
(h) 
Superintendent of the Orange Public Schools or his/her designee; and
(i) 
Seven Orange residents.
(2) 
All resident Board members shall serve without compensation. This Board should not be construed as a Board of Recreation pursuant to N.J.S.A. 40:12-1 et seq.
C. 
Term of office. The initial resident members of the Board shall serve as follows: two members shall serve for one year; three members shall serve for two years; and two members shall serve for three years. Thereafter all resident members shall be appointed for three-year terms. The Planning Board member's term shall correspond to his/her term on the Planning Board.
D. 
Responsibilities. The Board shall have the following powers and duties:
(1) 
Make recommendations to the Mayor regarding the overall administration of the Municipal Recreation and Open Space Trust Program pursuant to Public Law 1989, Chapter 30.
(2) 
Develop and recommend to the Mayor and City Council a system to prioritize the selection of open space areas for acquisitions.
(3) 
Review or prepare the present or proposed Parks, Recreation and Open Space Master Plan for the purpose of making recommendations to the Mayor.
(4) 
Identify and recommend to the City grants and other funding sources to maintain, expand and promote the existing open space.
(5) 
Make recommendations concerning the expenditure of funds as well as personnel where applicable in regards to the maintenance and preservation of said open spaces.
(6) 
Make recommendations concerning the selection of land for acquisition as part of the Open Space, Recreation and Historic Preservation Fund.
(7) 
Make recommendations as to historic preservation of historic properties, structures, facilities, sites, areas or objects, and the acquisition of such properties, structures, facilities, sites, areas or objects for historic preservation purposes.
E. 
Vacancies. Any vacancy on the Board shall be filled in the same manner in which the initial appointment was made.
F. 
Administration of Program. The Municipal Open Space, Recreation and Historic Preservation Trust Fund Program will be administered by the Administration. The Administration shall publish an annual report at the end of the fiscal year which shall be made available to the general public.

A. 
Public Works Committee Created. There is hereby created a Public Works Committee, consisting of eight (8) Orange citizens and the Business Administrator or his/her designee to be a recommending body to the administration and City Council in regards to public works matters of the City.
B. 
The Committee shall consist of eight (8) citizens (representing all wards of the City); seven (7) to be appointed by the City Council and one (1) to be appointed by the Mayor, and the Business Administrator or his/her designee. None of the eight (8) citizens of the committee shall be an elected official nor be employed by or have business dealings with or in any way be financially dependent on City of Orange Township Administration.
C. 
Term of office. The term of each appointment shall be two (2) years. New appointments shall be made in August of the election year.
D. 
Meetings. The Public Works Committee shall meet every month with the option of canceling any meeting due to lack of agenda items. Additional meeting may be added by the Committee as determined by the Committee members. The Public Works Committee shall arrange through the Council President to make monthly reports to the City Council at an agreed scheduled meeting. The City Council and Administration shall provide written responses to the Public Works Committee's reports.
E. 
Responsibilities. The Public Works Committee shall be a recommending body to the Department of Public Works, the Administration or City Council on policies relating to the following matters:
(1) 
Public Works City Maintenance Plans.
(2) 
Capital budget.
(3) 
Transportation (regional, local, and neighborhood).
(4) 
Seasonal policies and procedures.
(5) 
Maintenance of infrastructure and fleet management.
(6) 
Review of items that are referred by the administration or City Council.
(7) 
City items deemed appropriate by the Public Works Committee.
(8) 
Recommendations to the improvement of municipal parks/playgrounds.

A. 
Creation. There is hereby created the City of Orange Township Human Relations Commission, which shall be a part of the Mayor's Office.
B. 
Membership. The Commission shall be comprised of 11 members, each of whom shall be a resident of the City of Orange Township. The Mayor shall appoint three members and each member of the Municipal Council shall appoint one member. All members shall be known as Commissioners and the term of each Commissioner shall expire with the term of the elected official who appointed that Commissioner. Any subsequent appointments shall also expire with the term of the elected official who appointed that Commissioner. All vacancies shall be filled for the unexpired term only.
C. 
Adoption of bylaws. The Commission shall adopt bylaws to govern its operation, including specific goals and plans to achieve them, which shall be approved in advance by resolution of the Municipal Council.
D. 
Committees. The Commission may, by a majority vote of its Commissioners, create such subcommittee or subcommittees of its membership as they deem necessary and appropriate provided, however, that no subcommittee shall act for the Commission. The Commissioners may recruit and enlist volunteers who are residents of the City of Orange Township to assist them, but such volunteers shall have no voting rights and shall not speak for the Commission.
E. 
Chairperson. There shall be a Chairperson and Vice-Chairperson of the Commission who shall be designated by the Mayor for a term of one year provided, however, that the Mayor may reappoint any Commissioner as Chairperson from year to year. The Chairperson shall be selected by the Mayor from the 11 members of the Commission. All vacancies in the office of the Chairperson shall be filled for the unexpired term by the Mayor.
F. 
Duties and responsibilities. The Commission shall develop and implement programs which encourage a positive and constructive dialogue within the City of Orange Township on diversity and diversity-related issues. Among other events and activities, the Commission shall plan and coordinate the presentation of an annual Municipal-wide celebration in honor of Rev. Dr. Martin Luther King, Jr.'s birthday. The Commission shall encourage the inclusion of all residents of the Township in the leadership of civic and community issues and groups. The Commission shall be involved in community-building tasks and strategies to enhance and sustain respect among all of the diverse residents of the Township. The Commission shall develop formal and informal educational programs to eradicate all types of discrimination, to promote the celebration and preservation of our residents' unique cultural customs, and to promote the regular, civil and productive communication between the diverse groups of residents of the Township.
G. 
Annual budget. The Commission shall annually develop a tentative budget for the following year to be submitted to the Mayor for initial approval and subject to the Municipal Council's appropriation approval. Any funds raised through grant applications, fundraisers or solicitations shall be subject to all applicable laws and the regulations and procedures applicable through the NJ Division of Local Finance.
H. 
Annual report. The Commission shall submit an annual report in writing to the Mayor and Township Council setting forth its activities and accomplishments for the preceding year and its plans for the following year, including any new goals and plans to achieve them. The annual report shall be submitted by no later than January 15th for the preceding year. Each semi-annual report shall describe activities undertaken by the Committee and present recommendations for future activities deemed necessary for the Commission to discharge its duties and responsibilities.

No person shall be appointed to any municipal board, commission or authority of the City of Orange who at the time of the appointment is an employee of the City of Orange.

No person shall be employed by the City of Orange who, at the time of his employment, is a member of any municipal board, commission or authority of the City of Orange.

A. 
Any employee of the City of Orange, after acceptance of membership on any board, commission or authority of the City of Orange, shall make election as to continuance of employment or membership on any board, commission or authority; and upon failure to make such election, membership on any board, commission or authority shall be null and void.
B. 
Any member of a board, commission or authority of the City of Orange who shall be employed by the City of Orange shall make election as to continuance of membership on such board, commission or authority or employment; and upon failure to make such election, employment by the City of Orange shall be null and void.

As used in §§ 4-63.4 to 4-63.8, the following terms shall have the meanings indicated:
EMPLOYEE
Includes all classified and unclassified personnel of the City appointed in accordance with the Civil Service Act or appointed pursuant to the Municipal Code that receive their compensation from City funds.
MEMBERSHIP ON ANY BOARD, COMMISSION OR AUTHORITY
Includes all persons on any board, commission or authority nominated by the Mayor and confirmed by City Council, or those nominated by the Mayor without required confirmation by City Council, or those nominated by City Council without need of confirmation.

A. 
This article shall not apply to those City employees who presently serve upon any board, commission or authority but shall be effective upon termination of their appointment to any board, commission or authority.
B. 
This article shall not apply to simultaneous employment and membership upon any board, commission or authority as permitted by law or as authorized elsewhere in the Municipal Code.
