A. 
Enforcing agency established.
(1) 
There is hereby established in the City of Orange Township a State Uniform Construction Code enforcing agency within the Department of Planning and Economic Development to be known as the "Division of Building and Construction," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency. The enforcing agency shall be a division of the Department of Planning and Economic Development.

(2) 
The Fire Prevention Officer shall be responsible to the Fire Department for administrative and budgeting purposes, except as follows: For the purposes only of the enforcement of any subcode, specifically designated for such Fire Protection Subcode enforcement in Part II of the regulations of the New Jersey Uniform Construction Code within the jurisdiction of the enforcing agency, the Fire Protection Subcode Official shall be subject to the procedures and policies of the enforcing agency and shall be primarily responsible to the Construction Official.
B. 
Each official position created in Subsection A above shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one (1) such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217,[1] and N.J.A.C. 5:23 to hold each position.

The public shall have the right to do business with the enforcing agency at one (1) office location, except for emergencies and unforeseen or unavoidable circumstances.
A. 
There is hereby established a Board of Building Code Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five (5) members. At least one (1) Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one (1) Board member shall be as qualified as a Plumbing Subcode Official and one (1) as qualified as an Electrical Subcode Official. No more than two (2) Board members shall be selected from the same business or profession. Each Board member shall have had at least three (3) years' experience in construction, design or supervision as a licensed engineer or registered architect; or, in the alternative, five (5) years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education; or, as a further alternative, ten (10) years' experience in construction, design or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor, or inspector.

B. 
Appointments.
(1) 
The Mayor of the City of Orange Township shall appoint the Board members and any alternate members. For the members first appointed, the Mayor of the City of Orange shall designate the appointee's terms so that one (1) shall be appointed for a term of one (1) year, one (1) for a term of two (2) years, and one (1) for a term of three (3) years and two (2) for a term of four (4) years. At the expiration of such terms and thereafter, appointments shall be made for the terms of four (4) years. Vacancies shall be filled for unexpired terms.
(2) 
The Mayor of the City of Orange Township shall appoint such number of alternates as may be appropriate for terms not to exceed four (4) years or may, in the alternative, appoint alternates on a case-by-case basis.
(3) 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
C. 
Members of the Board shall serve without compensation.

A. 
The fee for a construction permit shall be the sum of the subcode fees listed in Subsection A(1) through (7) hereof and shall be paid to the City of Orange Township before the permit is issued.
(1) 
The Building Subcode fee schedule shall be as follows:
(a) 
For new construction for Use Groups B, H, I-1, I-2, I-3, M, E, R-1, R-2, R-3, R-4, and U:

Minimum fee: $500.
[2] 
Fees shall be $0.0420 per cubic foot.
(b) 
For renovations, alterations and repairs, based on estimated cost of construction:

Minimum fee: $100.
[2] 
Estimated cost up to and including $50,000: calculated at $34 per $1,000.
[3] 
Estimated cost from $50,000 to $100,000: calculated at $34 per $1,000.
[4] 
Estimated cost greater than $100,000: calculated at $34 per $1,000.
For the purpose of determining estimated cost, the applicant shall submit to the Construction Office such cost data as may be produced by the architect, engineer of record, recognized estimating firm or contractor. A bona fide contractor's bid, if available, shall be submitted. The Construction Official shall make the final decision regarding estimated cost.
(c) 
For additions: the fees for new construction will be as stated in Subsection A(1)(a) above. The portion of the job that is renovation or alteration work shall be fees as stated in Subsection A(1)(b) above.
(d) 
For new construction for Use Groups A-1, A-2, A-3, A-4, F-1, S-1, and S-2:

Minimum fee: $750.
[2] 
Fees shall be $0.0420 per cubic foot.
(e) 
Plan review. The fee for plan review shall be 20% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for the review shall be credited toward the amount of the fee to be charged for the construction permit.
(f) 
Sign construction. Fees shall be based on the surface area of the sign. Surface area for two-sided signs will be calculated by adding the surface area of both sides.

Pylon signs:

First 100 square feet: $5 per square foot.
[b] 
Next 400 square feet: $3.75 per square foot.

Remaining square feet: $2 per square foot.

[b] 
Next 400 square feet: $1.90 per square foot.
[c] 
Remaining square feet: $1.25 per square foot.
(g) 
Fees for inspections and the issuance of certificates of occupancy, approval and compliance shall be as follows:

Certificate of occupancy for the same use: $200.
[2] 
For a new building, the fee shall be in the amount of 10% of the new construction permit fee. The minimum fee shall be $250.
[3] 
Pursuant to a change of use, the fee shall be $500.

For a multiple certificate of continued occupancy, per occupancy: $200.
[5] 
Prior to sale or change in occupancy of any unit in an existing commercial structure or residential structure used for business purposes, a certificate of continued occupancy shall be issued. The certificate of continued occupancy shall be proof that the structure in question complies with all health and safety codes for the City of Orange Township and State of New Jersey. Unit owners and/or occupants operating as a partnership (general or limited), corporation or LLC will be required to provide proof of the entity’s registration, incorporation or formation (as appropriate) and a valid Employer Identification Number.

For an industrial change of use: $200.

For a certificate of approval: no fee.
[8] 
For a certificate of compliance: no fee.

Temporary certificate of occupancy: $250 each.
[10] 
For a certificate of clearance for lead abatement: $100.

For a certificate of occupancy for asbestos abatement: $50.
(h) 
Demolition. The minimum fee for a permit for demolition is as follows:

One-family dwelling: $300 flat fee (per structure).
[2] 
Residential garage: $200 flat fee (per structure).
[3] 
Two-family dwelling: $400 flat fee (per structure).
[4] 
Commercial building: $1,000 flat fee (per structure).
[5] 
Industrial building: $500 flat fee (per structure).
[6] 
Multifamily building: $500 flat fee (per structure).
[7] 
Mixed-use building: $1,000 flat fee (per structure).
(i) 
Removal of a building or structure shall be as a demolition in Subsection A(1)(h) above.
(j) 
Asbestos hazard abatement. The fee for each permit issued for asbestos hazard abatement shall be $150.
(k) 
Lead hazard abatement. The fee for each permit issued for lead hazard abatement shall be $200.
(l) 
Roofing and siding (R-2 and R-3 only): $100 each. All other use groups will be charged as alteration work.
(m) 
Retaining walls.

Surface area greater than 550 square feet when associated with a residential structure: $200.
[2] 
Surface area less than 500 square feet when associated with a residential structure: $125.
[3] 
The fee for new construction and/or commercial will be based on the cost of construction per alteration costs.
(n) 
Commercial farm building, new construction as specified by the UCC: fees based on cubic volume at $0.0010 per cubic foot with a maximum fee of $1,143.
(o) 
Any change in contractor listed on a Building Subcode permit: $100.
(2) 
The Plumbing and Mechanical Subcode fee schedules shall be as follows:
(a) 
Per fixture, equipment, or appliance connected to the plumbing system, and for each appliance connected to a gas piping/oil piping system: $20 each.
(b) 
Per special device, grease trap, oil separator, refrigeration unit, utility service connection, backflow preventer (Plumbing Subcode only), equipped with test parts, steam boiler, hot-water boiler, solar system, sewer pump, gas tank, and interceptor: $100 each.
(c) 
For backflow preventers (Plumbing Subcode only) and cross-connections that are subject to testing, requiring reinspection annually, the fee shall be $75 for each device when they are tested.
(d) 
The minimum fee shall be $100.
(e) 
Any change in contractor listed on a Plumbing Subcode permit or Mechanical Subcode permit: $100.
(f) 
Fees listed above are calculated separately for Plumbing Subcode and Mechanical Subcode permits and are not combined where both permits are required.
(3) 
The Electrical Subcode fee schedule shall be as follows:
(a) 
All switches, lighting and receptacles, fans and miscellaneous outlets:

The Fire Protection Subcode fee schedule shall be as follows:
(a) 
The minimum fee shall be $100.
(b) 
The fee for 20 or fewer sprinkler heads or detectors (smoke and heat) shall be $100; for 21 to and including 100 heads or detectors, the fee shall be $175; for 101 to and including 200 heads or detectors, the fee shall be $300; for 201 to and including 400 heads or detectors, the fee shall be $768; for 401 to and including 1,000 heads or detectors, the fee shall be $1,060; for over 1,000 heads or detectors, the fee shall be $1,343. In computing fees for heads and detectors, the number of each shall be counted separately, and two fees, one for heads and one for detectors, shall be charged.
(c) 
The fee for each standpipe shall be $300.
(d) 
The fee for each independent preengineered system shall be $150.
(e) 
The fee for each kitchen exhaust system shall be $150.
(f) 
The fee for each gas- or oil-fired appliance that is not connected to the plumbing system shall be $75.
(g) 
The fee for each incinerator or crematorium shall be $460.
(h) 
The fee for each private fire service main shall be $75.
(i) 
The fee for each reinspection caused by the failure of the owner or person responsible for the work to comply with the provisions of the code or permit: $75 for each reinspection for each item to be inspected.
(j) 
The fee for space heaters or HVAC units shall be $100 each.
(k) 
The fee for a smoke control system shall be $100.
(l) 
Any change in contractor listed on a Fire Protection Subcode permit: $100.
(5) 
Miscellaneous permits. The following fees shall be paid for the following miscellaneous permits:
(a) 
Oil-tank installation: $150 per 1,000 gallons.
(b) 
Gasoline tank installation: $100 per 1,000 gallons.
(c) 
Swimming pool construction:

Aboveground: $126 flat fee.

In-ground: $189 flat fee.
(d) 
Fence: $100 flat fee.

Commercial awning: $100 flat fee.

The fee for any reinspection of an elevator device shall be billed separately from the above fees upon the issuance of a notice of violation necessitating a reinspection.

There are hereby established in the City of Orange Township the following fire limits pursuant to N.J.A.C. 5:23:
A. 
Fire limits shall be all C-2, D-1 and M-1 zones set forth by the Zoning Ordinance, as amended on January 6, 1970, and also the block bounded east of South Center Street, south of Chapman Street, west of Hickory and north of Central Avenue.
