It shall be unlawful for any person to provide, leave or throw
food to or for any wild bird within 100 yards of any ocean waters,
except as permitted by the Department of Fish and Game, or within
50 yards of any private or publicly owned storm drain channel or other
conveyance, whether natural or man-made, through which water flows.
As used herein, wild birds includes, but is not limited to, birds
which are not regularly kept as private domestic pets on privately
owned property.

Violations of §
6-9.801 shall be punishable as an infraction for a first offense. A second violation committed within 12 months of the first violation, and any subsequent violations thereafter, shall be punishable as a misdemeanor.

In addition to or instead of the penalties prescribed above,
any violation of the provisions of this article shall constitute a
public nuisance and may be abated by restraining order or injunction
issued by a court of competent jurisdiction. The City shall be entitled
to collect all costs, including attorney's fees, of such abatement
from the violator in any such action.
