Effective January 15, 1973, all electrical, telephone, Community
Antenna Television System (CATV), and similar service wires or cables
which provide direct service to new buildings and structures shall
be installed underground.

The developer and the owner shall be jointly and severally responsible
for complying with the requirements of this chapter and shall make
the necessary arrangements with the utility companies for the installation
of such facilities.

For the purposes of this chapter, appurtenances and associated
equipment, such as, but not limited to, surface-mounted transformers,
pedestal mounted terminal boxes and meter cabinets, and concealed
ducts in an underground system may be placed aboveground if permitted
by and in accordance with the rules of the Public Utilities Commission
of the State.

Risers on poles and buildings shall be permitted and shall be
provided by the developer or owner on the pole which services such
property.

The provisions of this chapter shall not apply to utility lines
which do not provide service to the area being developed.

Any provision of this Code, or appendices thereto, or any other
law of the City inconsistent with the provisions of this chapter to
the extent of such inconsistencies, and no further, are hereby repealed.

If any section, subsection, sentence, clause, or phrase of this
chapter is for any reason held to be invalid or unconstitutional by
the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this chapter.

Any person violating any of the provisions of this chapter shall
be guilty of a misdemeanor and, upon conviction thereof, shall be
subject to a fine not exceeding $500 or six months' imprisonment
in the County Jail, or by both such fine and imprisonment in the discretion
of the court.
