C&D
Construction and demolition.
CONSTRUCTION AND DEMOLITION DEBRIS OR C&D DEBRIS
Solid waste that is a portion of the waste stream, defined
as "construction and demolition wastes" in Title 14 of California
Code of Regulations, § 17225.15, and shall mean commingled
and separated materials that result from construction work, that are
not hazardous, as defined in Article 3 of this chapter, and that contain
minor amounts of putrescible material of less than 1% per load deposited
for disposal at the City landfill or into an approved waste container.
CONSTRUCTION MATERIALS
Includes, but is not limited to, building materials, packaging,
and rubble resulting from construction, remodeling, repair and demolition
operations on pavements, parking lots, roads, residential and commercial
buildings and other structures.
UNSEPARATED FOR REUSE
C&D materials which have not been cut to size and separated
for reuse or disposal in accordance with the standards adopted by
the City's authorized waste contractor.

The City's authorized waste contractor shall adopt policies
and procedures consistent with this article to prevent the disposal
of C&D debris at the landfill.

All C&D materials generated in the City shall be either
(1) separated for reuse in accordance with the standards adopted by
the City's authorized waste contractor, transported for disposal
at an approved and certified mainland disposal site by the City's
authorized waste contractor, the charge for which shall be set by
resolution of the City Council and collected by the City's authorized
waste contractor, or (2) directly transported by the generator, owner,
or contractor for disposal at an approved and certified mainland disposal
site at the sole expense of the generator, owner, or contractor. For
purposes of this section, "Contractor" refers to a licensed contractor
transporting C&D Debris as an incidental part of its work, and
not the City's authorized waste contractors.

All applicants involved in C&D projects in or with the City
must divert 65% of all C&D waste generated at a site to a lawful
waste processing or recycling facility capable of receiving C&D
materials for potential reuse under the SB 1383 Regulations.

Violations of any provision of this article by any person or
entity, whether as principal, agent, employee or otherwise, shall
be prosecuted as an infraction or a misdemeanor in the discretion
of the prosecuting authority.
