An appeal for a special exception or variance to the terms of Article II of this chapter may be filed in writing with the Administrative Officer of Clearfield Borough and shall state the name and address of the applicant, the location where the proposed tree, trees or vegetation are to be located and the type and name of said tree, trees or vegetation.
The Administrative Officer shall consider the request for the exception or variance and shall notify the applicant of his decision in writing within 15 days, and if said request is denied, it shall be stated as to the reason of denial.
In the event that the applicant is dissatisfied with the findings of the Administrative Officer, he may, within 30 days of the notice of denial for exception or variance, file an appeal, without cost, on forms to be provided by Clearfield Borough.
Upon the filing of said appeal, any three members of the Clearfield Borough Planning Commission shall within 30 days order a hearing for the purpose of reconsidering the original request for an exception or variance. The Appeals Board shall give notice in writing to the applicant of the day, place and time of said hearing.
Within 10 days after said hearing, the Appeals Board shall make a decision in writing and notify the interested parties of the decision. The decision of the Appeals Board shall be final.
