As used in this article, the following terms shall have the meanings indicated:
FALSE FIRE ALARM
Any fire alarm received from a fire alarm system which has been caused by defect in the fire alarm system, accidental or careless use or misuse of the system or other undetermined causes and not caused by unfriendly fire.
YEARLY PERIOD
Yearly periods controlling the penalties charged hereunder shall be intended to mean the twelve-month period beginning January 1 and ending December 31 of each calendar year.
A. 
The owners of all premises shall be permitted three false fire alarms during any yearly period, as defined above, without penalty.
B. 
After three false alarms, the owners of the fire alarm systems on the premises from which the false alarms are received shall be notified by certified mail, return receipt requested, to repair such fire alarm system within 30 days.
C. 
In the event that a fourth false fire alarm from a premises shall be received within 30 days of owner's receipt of notices specified above and a system owner can prove that the alarm system is being repaired, then such false fire alarm shall be excused and there shall be no charge for such false alarm.
D. 
Should any fire alarm system cause more than three false alarms in one yearly period, the owner of such system shall be charged a graduated penalty for each such false alarm as follows:
(1) 
Fourth unexcused false fire alarm: $100.
(2) 
Fifth unexcused false fire alarm: $200.
(3) 
Sixth unexcused false fire alarm: $300.
(4) 
Seventh unexcused false fire alarm: $400.
(5) 
Eighth unexcused false fire alarm: $500.
(6) 
All subsequent unexcused false fire alarms during the year: $500.
The Borough Council shall have the power to excuse false fire alarms received during periods of public emergencies when such false fire alarm is caused by the condition giving rise to the emergency.
All penalties charged hereunder shall be billed in writing within 30 days of a false alarm for which such penalty is charged, and payment shall be made by the owner of the fire alarm system within 60 days of the date of such penalty bill or statement.
Any individual, establishment, partnership, corporation, entity or concern who shall fail or neglect to pay the penalty billed under this article within 60 days after formal billing, in writing, by the Borough Administrative Officer, shall, upon conviction, pay the penalty hereinbefore provided, together with costs of prosecution.
Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed.
