All line or partition fences shall be erected and maintained with due regard to the rights of adjoining property owners. It shall be unlawful for any owner of property within the limits of this Borough to erect or maintain or cause or permit to be erected or maintained any line or partition fence the motive for which is the interference with the light, air, view or convenient use or enjoyment of the adjoining premises by the owners or tenants thereof; nor shall any such fence be more than five feet in height or so erected as to be an annoyance either by reason of its unsightly appearance, its type of construction or other circumstances.
From and after the passage of this chapter, it shall be unlawful to erect or maintain billboards within the limits of any street or alley of Clearfield Borough or upon any line fence except for the advertising of products sold upon the premises. And no billboard shall be erected or maintained on private property in such a manner as to endanger the safety of persons or property.
Anyone violating the provisions of this chapter shall, upon complaint either by the person injured or by an officer of the law, be fined in a summary conviction proceeding before the Mayor or a Magisterial District Judge of the Borough a sum of not more than $25 or, in default of payment thereof, be committed to the county jail for a period not exceeding 30 days.
In event of failure to remove the fence or billboard upon 10 days' notice in writing to do so, the Borough may cause the same to be removed and the cost thereof to be collected by a civil action before the Mayor or a Magisterial District Judge or by the entry of a municipal lien.
