As used in this article, the following terms shall have the
meanings indicated:
FALSE FIRE ALARM
Any fire alarm received from a fire alarm system which has
been caused by defect in the fire alarm system, accidental or careless
use or misuse of the system or other undetermined causes and not caused
by unfriendly fire.
YEARLY PERIOD
Yearly periods controlling the penalties charged hereunder
shall be intended to mean the twelve-month period beginning January
1 and ending December 31 of each calendar year.
The Borough Council shall have the power to excuse false fire
alarms received during periods of public emergencies when such false
fire alarm is caused by the condition giving rise to the emergency.
All penalties charged hereunder shall be billed in writing within
30 days of a false alarm for which such penalty is charged, and payment
shall be made by the owner of the fire alarm system within 60 days
of the date of such penalty bill or statement.
Any individual, establishment, partnership, corporation, entity
or concern who shall fail or neglect to pay the penalty billed under
this article within 60 days after formal billing, in writing, by the
Borough Administrative Officer, shall, upon conviction, pay the penalty
hereinbefore provided, together with costs of prosecution.
Any and all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
