None but buildings of noncombustible materials and fireproof
roofs shall be erected, reconstructed or placed within that part of
the Borough of Clearfield bounded on the south by Walnut Street, on
the east by Fourth Street, on the north by Bridge Street and on the
west by the Susquehanna River, nor within a distance of 100 feet from
either side of that part of Bigler Avenue extending from Bridge Street
to Daisy Street, nor within a distance of 150 feet from either side
to that part of Nichols Street extending from the Susquehanna River
to Turnpike Avenue.
No roofs of combustible materials shall be reconstructed or
replaced upon any structure within the above described limits.
Any building erected, reconstructed or placed, or any roof reconstructed
or replaced contrary to the provisions of this chapter is hereby declared
to be a public nuisance and abatable as such.
Any person or persons, firm or corporations, either as principal
or agent, violating any portion of this chapter shall, upon conviction
before the Mayor or a Magisterial District Judge, be sentenced to
pay a fine of not less than $5 nor more than $10 per day for each
day during which this chapter is violated, and in default of the payment
thereof, with costs, shall undergo imprisonment in the county jail
for a period not to exceed 30 days.
The Council may issue temporary permits, revocable at any time
by motion of Council, for the building of temporary wooden structures
or outhouses within the above described limits, provided plans are
first submitted to and approved by the Council.
All ordinances or parts of ordinances inconsistent herewith
be and the same are hereby repealed.
