The grant and use of and payment for unused sick leave for the benefit of members of the Police Department, Fire Department, and blue collar employees of the Public Works Department and Buildings, Parks and Grounds Department of this City shall be set forth, from time to time, in collective bargaining agreements between the City and the bargaining representation for said departments.
All the officers and employees in the classified service of this municipality, as defined by the civil service statutes effective in this state, shall be governed by the terms of this article with respect to accumulated sick leave as a supplemental retirement benefit.
For the purpose of this article and in the interpretation and application hereof, except as the context may otherwise require, as used in this section, the following terms shall have the meanings indicated:
COMPENSATION
An employee's average annual compensation during the last year of his full-time permanent employment with the City of North Wildwood prior to the employee's retirement date.
DAILY RATE
Compensation, as herein defined, divided by the number of working days in the particular employee's last year of full-time permanent employment.
FULL-TIME PERMANENT EMPLOYMENT
Any assignment, within the classified service aforesaid, to any position of full-time employment with the City of North Wildwood for an indeterminate period as defined by the New Jersey Department of Civil Service.
LONGEVITY FACTOR
A factor based upon the employee's length of full-time permanent employment with the City of North Wildwood, which shall be utilized to determine benefits as provided herein. Any employee in his final year of employment who works more than six months shall be credited for the full year; whereas, if the employee works for less than six months, he will get no additional credit. The "longevity factor" shall be as follows:

Includes any resignation after 14 years of service.
UNUSED SICK LEAVE
The number of days of accumulated sick leave accrued during the employee's full-time permanent employment with the City of North Wildwood, which is credited to the employee on his effective retirement date.
Each and every full-time permanent employee of the City of North Wildwood shall be entitled, at the time of retirement, to receive a supplemental retirement benefit for unused accumulated sick leave credited to him on the effective date of his retirement.
Except as otherwise noted herein, each said retiring employee shall receive a supplemental retirement benefit for unused sick leave which shall be determined by multiplying the number of days of unused sick leave by the daily rate and then multiplying that result by the longevity factor.

In no event shall a supplemental retirement benefit, as provided for herein, exceed a total of $10,000.
Upon application by a retiring employee, at least 60 days prior to retirement, the appointing authority shall certify the amount of unused sick leave. The payment on account therefor shall be made by the City of North Wildwood to the retiring employee in three equal annual installments commencing on the first day of July of the year following the year of the employee's effective retirement date. In the event of the death of the employee subsequent to the effective retirement date, but prior to payment of any or all the installments of said supplemental retirement benefit, the installment or installments falling due after the death of the employee will be made to the executor, administrator, legatee or next of kin, as determined in the sole discretion of the City of North Wildwood, upon submission of proper proof of entitlement by that person making a claim therefor, and any such decision by the City of North Wildwood and payment pursuant thereto shall be final and conclusive as to all persons and shall discharge the City of North Wildwood, to the extent of such payment, from any further liability to any other person with respect thereto.
