The City of North Wildwood is hereby authorized to award a contract for the operation of kayaks on the North Wildwood beach front between 8th and 10th Avenue and to determine the rules, regulations and specifications in connection therewith.
It shall be unlawful for any person to operate a kayak without wearing a coast guard approved life jacket and a helmet approved by the Beach Supervisor of the City of North Wildwood at all times while in a kayak on the water.
It shall be unlawful to ride in or operate a kayak in any fashion in a reckless, careless or negligent manner so as to endanger any person or property. The following acts are specifically prohibited:
A. 
The use of the paddles for any purpose other than to mobilize or steer a kayak.
B. 
Standing up in the kayak while the kayak is in the water, except when immediately entering or departing the kayak.
C. 
Splashing water upon another kayak or to make physical contact with another kayak with one's hands, feet or other objects which might tend to cause such other kayak to tip over.

Any person convicted of a violation of the provisions of this article shall, upon conviction thereof, be subject to a fine not to exceed $2,000, imprisonment for not more than 90 days, or community service for not more than 90 days, or any combination thereof.
