There is hereby established a Purchasing Agent within the Township of Franklin. The purpose of this chapter is to prescribe the manner in which said Purchasing Agent shall control the purchasing of materials, supplies and equipment for the Township.
The Purchasing Agent shall have the power and it shall be his duty to:
A. 
Approve the purchase for all materials, supplies, equipment and contractual services needed by any department or agency of the Township which derives its financial support from the Township in accordance with purchasing procedures prescribed by this chapter and such rules and regulations as the Purchasing Agent shall adopt for the management and operation of his office.
B. 
Purchase or procure for the Township the highest quality in materials, supplies, equipment and contractual services from the lowest responsible bidder meeting specifications.
C. 
Discourage uniform bidding and endeavor to obtain full and open competition insofar as possible on all purchases.
D. 
Establish and amend when necessary all rules and regulations authorized by or promulgated under this chapter and any other necessary to its operation.
E. 
Keep informed of current developments in the fields of purchasing, prices, market conditions and new products and secure for the Township the benefit of research done in the field of purchasing by other governmental jurisdictions.
F. 
Prescribe and maintain such forms as he shall find reasonably necessary to the operation of this chapter.
G. 
Prepare and secure, with cooperation from the various Township departments and agencies, standard and written specifications for supplies used by the various branches of the Township government.
A. 
All supplies and contractual services, except as otherwise provided herein, shall be made in conformance with N.J.S.A. 40A:11-3.

B. 
Authorization to publicly advertise for formal bids shall be initiated by approval of the Township Committee.
C. 
Formal bids shall be received by the Township Committee unless the Township Committee authorizes public advertisement to direct bids to be received by the Purchasing Agent.
D. 
The Purchasing Agent shall review bids and submit recommendations as to the award to the Township Committee.
E. 
The Township Committee shall award or reject bids under this section.
A. 
All purchases of supplies and contractual services of less than the bid threshold established by N.J.S.A. 40A:11-3 may be made in open market without newspaper advertisement and without observing the procedure prescribed in § 106-3 for the award of formal contract provided that the procedures of N.J.S.A. 40A:11-6.1 are followed.

B. 
All open market purchases, the estimated cost or price of which is $500 or more, shall, whenever possible in accordance with the provisions of N.J.S.A. 40A:11-6.1, be made after the Purchasing Agent obtains at least three competitive bids.
A. 
The Purchasing Agent may waive in the case of an emergency any rules and regulations established in this chapter or rules and regulations established by the agent for the purchase of any items when the actual aggregate value thereof shall not exceed the bid threshold established by N.J.S.A. 40A:11-3.

B. 
The Township Committee may, in accordance with the provisions of N.J.S.A. 40A:11-6, authorize the Purchasing Agent in case of an emergency to purchase or contract for supplies or services necessary to address the emergency consistent with state law.

C. 
The Purchasing Agent shall report all such emergency purchases to the Township Committee, explaining the circumstances causing the emergency purchase. Any such emergency purchases authorized by the Township Committee of $2,500 or more shall be thereafter confirmed by resolution.
The annual salary for the office of Purchasing Agent shall be determined from time to time by the Township Committee and shall be paid in accordance with the provisions of the annual Salary Ordinance[1] of the Township of Franklin.
