It shall be unlawful to operate or conduct any public dance hall or public place or places where dancing is permitted or to operate or conduct any circus, carnival or street show without first obtaining a license issued by the authority of the Township Committee of the Township of Franklin, which said license shall be issued by the Township Clerk, upon approval thereof, being given in writing by the Township Committee so to do; provided, however, that fraternal and charitable organizations, clubs, churches or beneficial associations may be issued a license without charge at the option of the Township Committee.
Every such license shall remain in force and be valid only for one year from the date the same shall be issued and shall apply only to the person, persons or corporation to whom granted and shall not be transferable.
Any person, persons or corporation to whom such license shall be granted, as herein provided, is hereby required to exhibit such license whenever called upon so to do by any duly authorized officer or member of the Township Committee of the Township of Franklin.
The Township Committee of the Township of Franklin is hereby empowered to issue such licenses for the following fees:
A. 
Public dance halls and places where public dancing is permitted: $10 per year.
B. 
Circuses, traveling carnivals and traveling shows: $10 per day.
C. 
A licensee who fails to submit a renewal application by December 31 shall pay, in addition to the annual license fee, a late charge of $50. The late charge shall not be the exclusive penalty, but shall be in addition to any other penalties provided for in this chapter.

All such licenses hereby authorized may be revoked at the option of the Township Committee when public safety is in danger or in the event that the holder or holders of any such license shall create a nuisance or violate the statutes of the State of New Jersey or the ordinances of the Township of Franklin; provided, however, that before any such license shall be revoked, such person, persons or corporation alleged to be offending shall be granted a public hearing by the Township Committee.
An ordinance heretofore finally passed by the Township. Committee of the Township of Franklin, at a meeting held May 2, 1932, and entitled "An Ordinance Providing for the Licensing and Regulating of Places of Amusement and Pool and Billiard Rooms in the Township of Franklin, County of Gloucester and State of New Jersey," is hereby repealed.
Roller-skating rinks and bowling alleys shall also be subject to the provisions of this ordinance.
A. 
All licensees licensed under this chapter shall comply with the following table on occupancy allowances:

B. 
The Township Committee shall have the privilege to inspect the premises of any license holder for the purpose of determining whether the above table of occupancy allowances is being complied with. If it is determined that occupancy allowances are being exceeded, the license issued under this chapter shall be revoked forthwith.

Before any license provided for herein shall issue, the applicant shall deposit with the Township Clerk of the Township of Franklin, County of Gloucester and State of New Jersey, a certificate of public liability insurance of an insurance company licensed to do business in the State of New Jersey, providing for property damage coverage of $5,000 and personal injury in the sum of $100,000 per person and $300,000 per accident, and the same shall be deposited with the Township Clerk of the Township of Franklin before any such license shall issue. The Township Committee may waive this insurance requirement or require a lesser amount after a fall investigation of the applicant.
Any person, persons or corporation who shall run, operate or maintain any of the places hereinbefore enumerated in this chapter without first obtaining a license, or after said license therefor shall have been revoked or shall have expired, shall pay a fine for each offense of $100 or imprisonment in the county jail for not more than 90 days.
