It is the desire of the Council of the Borough of Monaca, Beaver County, Pennsylvania, and said Council hereby signifies its intention to organize a Downtown Monaca Business District Authority under the Municipality Authorities Act of May 2, 1945, P.L. 382, as amended.[1]

The Council of the Borough of Monaca hereby finds and determines that improvement of the Business District by the creation of the Downtown Monaca Business District Authority is desirable for the entire Borough of Monaca and hereby defines said Business District for the purposes contemplated by this article as the area within the Borough of Monaca which is presently zoned commercial and/or contains generally commercial uses.[1]

It is specified that Borough Council retains the right existing under the Act to approve any plan of the Authority.
The name of the proposed Authority shall be the "Downtown Monaca Business District Authority."

The Board of the Downtown Monaca Business District Authority shall consist of nine members. The terms of five members of the Authority shall be for three years, and four members shall serve for two years. The Chairman of the Authority shall promptly notify the appointing body of the municipality concerning vacancies in the Authority, and such vacancy shall be filled for the unexpired term.
Pursuant to said desire and intention of the Council of the Borough of Monaca and in conformance with the terms and provisions of said Municipality Authorities Act of 1945[1] and its amendments, the proposed Articles of Incorporation are hereby set forth in full, as follows.[2]

The proposed Articles of Incorporation of the Downtown Monaca Business District Authority shall be executed by and on behalf of the Borough of Monaca by the President of the Council, Mayor and Borough Secretary of the Borough of Monaca and filed with the Secretary of the Commonwealth. The Borough Solicitor is hereby authorized and directed to cause to be published the notice of the intention to file the Articles of Incorporation with the Secretary of the Commonwealth as required by the aforementioned Act.

It is the desire and intention of the municipal authorities of the Borough of Monaca to organize an Authority under the Parking Authorities Act of 1947, approved June 5, 1947, P.L. 458, as amended, for the purpose of exercising any and all of the powers conferred by said Act. (53 P.S. §§ 341 through 356)[1]

The name of the proposed Authority is the "Monaca Borough Parking Authority."
The following terms whenever used or referred to in this article shall have the following meanings, except in those instances where the context clearly indicates otherwise:
AUTHORITY
A body politic and corporate created pursuant to this article.
BOARD
The governing body of the Authority.
BONDS
Includes the notes, bonds and other evidence of indebtedness, or obligations which the Authority is authorized to issue pursuant to 53 P.S. § 345 of the Parking Authorities Act.[1]

BOROUGH
As defined in the Commonwealth of Pennsylvania Borough Code, Act of February 1, 1966, as amended.[2]
CONSTRUCTION
Includes acquisition and construction, and the term "to construct" shall mean and include to acquire and to construct, all in such manner as may be deemed desirable.
FACILITY or FACILITIES
Lot or lots, buildings and structures above, at or below the surface of the earth, including equipment, entrances, exits, fencing and all other accessories necessary or desirable for the safety and convenience of the parking of vehicles.
FEDERAL AGENCY
Includes the United States of America, the President of the United States of America and any department or corporation agency or instrumentality heretofore or hereafter created, designated or established by the United States of America.
IMPROVEMENT
Includes extension, enlargement and improvement, and the term "to improve" shall mean and include to extend, to enlarge and to improve, all in such manner as may be deemed desirable.
MUNICIPALITY
Any county, city, town, borough or township of the Commonwealth of Pennsylvania.
PERSONS
Includes natural persons.
PROJECT
Any structure, facility or undertaking which the Authority is authorized to acquire, construct, improve, maintain or operate under the provisions of this article.

The Articles of Incorporation of said Authority in substantially the form set forth in § 9-11 of this article shall be executed on behalf of the Borough of Monaca by the President of Council and the Mayor of the Borough of Monaca under its Municipal Seal, attested by the Secretary of the Borough; and such officers are hereby authorized, empowered and directed to do all things necessary and appropriate to effect and establish said Authority in conformity with the Parking Authorities Act of 1947, as amended by the Act of 1951.[2]

A. 
The Borough hereby confers by its powers unto the Monaca Parking Authority the complete power to regulate, maintain the manner of parking in, set the parking fees for, enforce penalties for violations of and collect the fines assessed against any owner of any vehicle in any official metered parking lot situate in the Borough of Monaca and in any two-hour parking zone.
B. 
In all other respects, the Monaca Parking Authority shall have the same powers as the Borough of Monaca has pursuant to this article.
C. 
The Monaca Parking Authority shall exercise the powers conferred hereunder in any manner it deems to be fit and proper according to the laws of the Commonwealth of Pennsylvania.
