The provisions of this chapter shall apply to govern and regulate the design and installation of plumbing systems, including sanitary and storm drainage, sanitary facilities, water supplies and stormwater and sewage disposal as herein defined, and shall apply to existing or proposed buildings and structures in the Borough of Monaca.
A certain document, two copies of which are on file in the office of the Borough Manager of the Borough of Monaca, being marked and designated as the "BOCA National Plumbing Code, Ninth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the plumbing code of the Borough of Monaca in the Commonwealth of Pennsylvania for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 165-3 of this chapter.
The following sections are hereby revised as follows:
A. 
Section P-101.1, Title, shall be amended as follows:
P-101.1 Title: These regulations shall be known as the "Plumbing Code of the Borough of Monaca," hereinafter referred to as "this chapter."
B. 
Section P-113.2 is amended to read as follows:
P-113.2 Schedule of fees:
1.
The fee to be paid to the Borough of Monaca for a plumbing permit shall be as set forth from time to time by resolution of the Borough Council.[1]

C. 
Section P-116.4, Violation penalties, shall be amended as follows:
P-116.4 Violation penalties: Any person who shall violate any provision of this chapter or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair plumbing work in violation of the approved construction documents or directive of the code official or of a permit certificate issued under the provision of this chapter shall be guilty of a summary offense, punishable by a fine of not more than $1,000, and in default of payment thereof, imprisonment not exceeding 30 days. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
D. 
Section P-117.2, Unlawful continuance, shall be amended as follows:
P-117.2 Unlawful continuance: Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine not more than $1,000.
E. 
Section P-304.3, Public systems available, shall be amended as follows:
P-304.3 Public systems available: A public water main or public sewer system shall be considered available to a structure where the structure is located within 150 feet of the public water main or sewer.
F. 
Section P-309.4, Freezing, shall be amended as follows:
P-309.4 Freezing: Water service piping shall be installed below recorded frost penetration but not less than three feet below grade. In climates with freezing temperatures, plumbing piping in exterior building walls or areas subjected to freezing temperatures shall be protected against freezing by insulation or heat, or both.
G. 
Section P-309.5, Sewer depth, shall be amended as follows:
P-309.5 Sewer depth: Building sewers that connect to private sewage disposal systems shall be a minimum of 36 inches below finished grade at the point of septic tank connections. Building sewers shall be a minimum of 36 inches below grade.
A. 
Registered plumber's license. No individual shall engage in the business of plumbing in the Borough of Monaca unless licensed as a registered plumber under the provisions of this chapter.
B. 
Supervision of work. No individual, firm, partnership or corporation shall engage in the business of installing, repairing or altering plumbing unless the plumbing work performed in the course of such business is under the direct supervision of a licensed registered plumber.
C. 
Plumber's Examining Board.
(1) 
Board personnel. There is hereby established a Plumber's Examining Board (hereinafter referred to as the "Board") to consist of not fewer than four members. One member shall represent the Board of Health, one member shall be a registered plumber, one member shall represent the public, and one member shall be a Councilman. The members of the Board shall be appointed by the Council of the Borough of Monaca.
(2) 
Meetings of the Board. The Board shall hold its first meeting not later than 30 days following the adoption of this chapter. Thereafter the Board shall meet at such intervals as may be necessary for the proper performance of its duties, but in any case not less than twice a year.
(3) 
Examination and certification.
(a) 
The Board shall establish standards and procedures for the qualification, examination and licensing of registered plumbers and shall issue an appropriate license to each person who meets the qualifications therefor and successfully passes the examination given by the Board. The Board shall keep an official record of all its transactions.

All licenses shall be valid for one calendar year.
[2] 
No master plumber's license shall be granted to a journeyman plumber until he has had at least one year's experience as a licensed journeyman plumber and has successfully passed the required examination.
[3] 
No journeyman plumber's license shall be granted a registered apprentice plumber until he has a minimum of four years' experience as a registered apprentice plumber, has satisfactorily completed 576 hours of related technical training at an accredited school and has successfully passed the required examination.
(b) 
These requirements shall be effective as of the date of adoption of this chapter. Individuals prior licensed as masters and journeyman plumbers shall be relieved of this requirement.
(4) 
Reexamination. Any person who fails to pass an examination as prescribed by the Board may apply for reexamination after the expiration of 30 days, upon payment of the regular examination fee.
(5) 
Temporary permit. The Board may issue a temporary license pending examination, provided that the applicant holds a similar license from an equivalent board.
D. 
Examination fee. Any person desiring to be licensed as a registered plumber shall make written application to the Board. Examination fees for registered (plumber) licenses shall be as set from time to time by resolution of the Borough Council.[1] Payment of such fee, made payable to the Borough, shall accompany the application. Examination fees not returnable.

E. 
Fees for expiration; renewal; revocation.
(1) 
Yearly fee to be paid to the Borough. All licenses issued by the Board shall expire on December 31 of the year in which issued but may be renewed upon payment of a fee as set from time to time by the Borough Council.[2] The initial license fee shall be as set from time to time by resolution of the Borough Council,[3] which shall be in addition to an examination fee, if required.

(2) 
Revocations.
(a) 
The Board may revoke any license if obtained through nondisclosure, misstatement or misrepresentation of a material fact or if a penalty has been imposed on a licensee.
(b) 
Before a license may be revoked, the licensee shall have notice in writing, enumerating the charges against him, and be entitled to a hearing by the Board not sooner than five days from receipt of the notice. The licensee shall be given an opportunity to present testimony, oral or written, and shall have the right to cross-examination. All testimony shall be given under oath. The Board shall have power to administer oaths, issue subpoenas and compel attendance of witnesses. The decision of the Board shall be based on the evidence produced at the hearing and made part of the record thereof. A person whose license has been revoked shall not be permitted to apply within one year from the date of revocation.
