It shall be unlawful for any property owner to construct any fence or
enclosure wall within the confines of the Borough of Monaca without first
filing an application with the Building Inspector and obtaining the required
permit for such purposes.
Fences, hedges and enclosure walls may not exceed 36 inches within the
confines of a front yard or 48 inches within the confines of a side yard.
Fences, hedges and enclosure walls around the back yard may not exceed six
feet in height. All such fences, hedges and enclosure walls as mentioned above
shall be located a minimum distance of 12 inches away from the property line.
The Building Inspector shall have a right to deny any permit application for
fences which he feels would cause a safety hazard due to view obstruction.
With the exception to any stipulation in this chapter, any fence, hedge or
enclosure wall presently causing a safety hazard due to view obstruction shall
be eliminated in a means determined by the governing body.

For all applications for fences and enclosure walls where said property is situated as a corner lot on a street, the height of said fences and enclosure walls shall be regulated by Ch.
245, Zoning.

A fee as set from time to time by resolution of the Borough Council
will be charged for each permit for fences and enclosure walls.
Any person wishing to construct a fence, hedge or enclosure wall in
excess of the height or any other requirements stipulated by this chapter
may appear before the governing body to present such request. The governing
body may approve such request if deemed in the best interest of the Borough.

These height restrictions shall not apply to fences or other screening
surrounding automobile salvage yards and multifamily dwelling refuse facilities.

Any person violating any provision of this chapter shall, upon conviction thereof shall be punishable as provided in Chapter
1, Article
II, Code Enforcement.
