A. 
Whereas the Board of Commissioners of York County, Pennsylvania, finds that there is a need to promote the use of the former Northern Central Railroad line extending from the Maryland border to the City of York for the purposes of transportation and parks and recreation grounds through the creation of an authority pursuant to the Municipality Authorities Act of 1945, as amended.
B. 
Now, therefore, the Board of Commissioners signifies the intention of York County to organize an authority under the Municipality Authorities Act of 1945, Act of May 2, 1945, P.L. 382, Sec. 1 et seq., 53 P.S. § 301 et seq., as follows.
The name of the Authority is "York County Rail/Trail Authority."
The Authority is formed under the Municipality Authorities Act of 1945, as amended.[1]

The purpose or purposes of such Authority are acquiring, holding, constructing, financing, improving, maintaining and operating, owning and leasing, either in the capacity of lessor or lessee, projects for transportation and for parks, recreation grounds and facilities in and along the former Northern Central Railway line extending from the Maryland border into York County and in and along any other rail line or right-of-way hereafter acquired or held or improved, maintained or operated by the Authority.
Any other authority or authorities organized and in existence for the incorporating municipality or municipalities are York Area Transportation Authority[1] and York County Solid Waste and Refuse Authority and York County Industrial Development Authority and York County Hospital Authority.

The municipality or municipalities have retained the right which exists under the Municipality Authorities Act of 1945 to approve any plan of the Authority, in the case of authorities created for the purpose of making business improvements or providing administrative services, if appropriate.
The Articles of Incorporation for the Rail/Trail Authority are as follows:
Articles of Incorporation
a)
The name of the Authority is the "York County Rail/Trail Authority."
b)
The Authority is formed under the Municipality Authorities Act of 1945.
c)
The purpose or purposes of such Authority are acquiring, holding, constructing, financing, improving, maintaining and operating, owning and leasing, either in the capacity of lessor or lessee, projects for transportation and for parks, including linear parks, recreation grounds and facilities in and along the former Northern Central Railway line extending from the Maryland border into York County and such other projects as the Authority may from time to time select, located in or portions of which are located in York County.

Any other authority or authorities, organized and in existence for the incorporating municipality or municipalities, are the York Area Transportation Authority[1] and York County Solid Waste and Refuse Authority and York County Industrial Development Authority and York County Hospital Authority.

The name of the incorporating municipality is the "County of York."
