It shall be unlawful, after the approval of this chapter, to plant along the sidewalks of the Borough of Kittanning, between the property line and the curbline, Carolina poplar trees, and the planting of such trees is hereby declared to be unlawful and a public nuisance and removable as such.
All Carolina poplar trees now located and growing on the sidewalks, between the curbline and property line, in the Borough of Kittanning, shall be trimmed and cut back to a height of not exceeding 30 feet above the ground, and poplar trees exceeding 30 feet in height are hereby declared to be a nuisance and shall be trimmed and cut back to a height of not exceeding 30 feet.
Upon failure of any property owner in front of whose property Carolina poplar trees are located and growing, within 10 days after receipt of notice from the Borough authorities to trim and cut back said trees to the height specified in this chapter, the Council shall cause such trees to be trimmed and cut back to the height specified, and will collect from such owner or owners the entire cost of the work done in connection with the trimming and cutting back of said tree or trees.
All trees on or along the sidewalks in the Borough of Kittanning, between the curb and the property line, shall be trimmed to a height of at least eight feet above the sidewalks and at least 13 1/2 feet above the cartway, at the expense of the owner in front of or along whose property such trees are located, and, upon failure of any property owner within 10 days after receipt of notice from the Borough authorities to trim the tree or trees in front of or along his property to a height of at least eight feet above the sidewalk and at least 13 1/2 feet above the cartway, Council shall cause such trees to be trimmed to the height so specified, and shall collect from such owner or owners the cost of the work done in connection with the same

Any person or persons, partnership, firm or corporation violating any provision of § 507-1 of this chapter shall, upon conviction, be sentenced to pay a fine of not more than $600 and costs of prosecution, and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days, and, in addition, the tree or trees planted in violation of that section shall immediately be removed under the direction of Council and at the expense of the violator.
