Except as provided herein, no person shall use Kittanning Borough property in any way to withdraw water from the Allegheny River for any purpose.[1]

As used in this article, the following terms shall have the meanings indicated:
PERSON
Individual persons, partnerships, limited liability companies, corporations, or any other business entity.
Kittanning Borough Council is hereby authorized to negotiate and enter into a written agreement with any person who desires to have permission to use Borough property to withdraw water from the Allegheny River. Such written agreements may be for a term of one or more years, and shall provide for the payment of reasonable compensation to Kittanning Borough for the deterioration of Borough streets and other property as a result of the hauling of large quantities of water.
A violation of this article shall be a summary offense, punishable by not more than $600. Each day of violation shall be a separate offense.
