Ordinance No. 1360 of 2015 is hereby repealed.
For the purpose of this chapter, the following words and terms are defined as herein indicated:
ADMINISTRATOR
The Borough Manager of the Borough of Etna.
AUTOMOBILE
Passenger vehicle, as defined in Section 102 of the Pennsylvania Motor Vehicle Code Title 75.
CAREGIVER
Any person charged with the responsibility of rendering care to the ill, infirm, disabled, etc. Examples would include, but not be limited to, senior care, child care, nanny, hospice or home health care nurse, etc.
COMPANY AUTOMOBILE
Passenger vehicle as defined in Section 102 of the Pennsylvania Motor Vehicle Code Title 75, used in conjunction with the respective applicant's employer.
HOUSEHOLD
Single-family dwelling, townhouse, duplex, individual apartment, individual condominium, and any other residence that requires a separate mailing address.
IMMEDIATE FAMILY
Immediate family consists of the resident's spouse, children, mother, father, brother, sister, father-in-law, mother-in-law, son-in-law, daughter-in-law, grandfather or grandmother.
MOTORCYCLE
A motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground.
NONRESIDENT
A licensed driver who does not reside in the designated parking zone of the Borough of Etna and who has an inspected, insured and operable vehicle registered in his or her own name.
RECREATIONAL VEHICLES
Any camper, trailer, boat or other wheeled vehicle designed to be drawn by passenger automobile or other vehicle, and not primarily designed for day-to-day passenger transport over the roadways. This shall apply to any such recreational vehicle larger than seven feet by 15 feet but not to exceed 10 feet by 20 feet.
REGISTERED VEHICLE
A vehicle with a current vehicle registration in accordance with the Pennsylvania Motor Vehicle Code, Title 75 Pa.C.S.A.
RELATIVE
Immediate family member, as defined herein, brother-in-law, sister-in-law, uncle, aunt, first cousin, stepfather, stepbrother, stepsister, stepson or stepdaughter.
RESIDENT
A licensed driver who resides in the Borough of Etna and who has an inspected, insured and operable automobile or motorcycle, currently registered in their own name or in the name of a relative residing at the same address.
RESIDENTIAL PARKING PERMIT
Duly authorized permit from the Borough of Etna, issued by the administrator or his or her designee to a permit holder, allowing on-street parking in the designated area.

This article of this chapter of the Borough of Etna Code establishes a residential parking district encompassing the following streets in the Borough of Etna: Lower Locust Street, between Walnut Street and High Street; Locust Street on the even-numbered side (from High Street to Maplewood Street); Locust Street on the odd-numbered side (from Maplewood Street to Pine Street); and the odd-numbered side of Pine Street; and all of Garrick Street; and Maplewood Street from Locust Street to Garrick Street. Thus, Maplewood Street, from the intersection of Garrick Street to Hickory Street, is excluded from the Residential Permit Parking District. The address 111 Locust Street is hereby included and made part of the Residential Permit Parking District.
A. 
Resident permit:
(1) 
Proof of residency, which shall include any two of the following bearing a Borough of Etna address: Tax receipts, utility bill, property closing statement, driver's license, bank statement, lease, vehicle registration, or deed:
(a) 
Verification of car ownership and/or specific written permission to operate a company automobile.
(b) 
Payment of the permit fee in full.
(c) 
Proof of current registration.
(d) 
Proof of current insurance.
(e) 
Proof of valid driver's license with the address located in the designated permit zone.
(f) 
Proof of payment of all wage and property taxes.
B. 
Visitor permit.
(1) 
Only one visitor permit may be purchased at a time and will be issued to the resident for his/her visitors. Each permit is good for seven uses in a thirty-day period.
(2) 
The visitor permit shall be displayed on the front dashboard of the vehicle and is reusable for seven occurrences. No one visitor permit may be used in excess of seven consecutive days or seven total days in a thirty-day period. A visitor pass is only expired after seven uses, regardless of date of issue; however, only one can be purchased during a thirty-day period. In order to purchase a subsequent visitor pass, the expired pass must be surrendered to the Borough officials.
(3) 
Overnight visits will require a visitor pass.
C. 
Caregiver permit.
(1) 
Residents or nonresidents who have dependents living in the Borough, requiring the services of a caregiver (i.e., hospice, home health services, senior care, nanny/childcare), may apply for a "caregiver" permit.
(2) 
One such permit may be purchased at the resident parking fee rate and will be issued for one year to the resident as a caregiver.
(3) 
The Borough resident must show proof of residency and submit a statement of need.
(4) 
These permits will be reviewed by the parking administrator and/or his or her designee.
D. 
Contractor permit.
(1) 
Any contractor performing services in the Residential Permit Parking District shall first obtain a permit for such work, free of charge, at the Etna Borough office.
A. 
Company automobile.
(1) 
When a resident utilizes a company automobile and wishes to apply for an on-street parking permit for said vehicle, an exception shall be made to allow for the application for a parking permit.
(2) 
This exception shall be limited to only one company automobile per household and will not be in addition to the total number of vehicles.
A. 
All residents residing in the Residential Permit Parking District shall apply for a permit within 30 days of the effective date of this chapter.
B. 
Any new resident in the Residential Permit Parking District shall apply for a permit within 30 days of their occupancy of a residence in the Residential Permit Parking District.
A. 
Permits shall be purchased on or before March 31 of the current year. Permits are valid for 12 months (April 1 until March 31).
B. 
A permit issued after September 30 may be purchased at 1/2 of the yearly cost.
C. 
Permits shall be displayed inside the vehicle on the rear-view mirror so as to be readily visible from outside the vehicle. Visitor permits must be displayed on the front dashboard with the current date clearly written on it and plainly visible.
A. 
Fees for on-street parking permits established by this chapter are as follows.
(1) 
Resident parking permit: $20, annually.
(2) 
Visitor parking permit: $10 (valid for seven uses).
(3) 
Caregiver parking permit: $20, annually.
B. 
All fees established by this article may be changed or amended by resolution of the Council of the Borough of Etna.
A. 
To park on a street where it is legally permissible to do so requires a permit.
B. 
Permits will be limited to one permit per household per corresponding registered vehicle for an on-street permit.
C. 
Permits will be limited to two parking spaces per household. If the household has a garage or off-street parking available, that will count for one space; therefore, that residence would only be eligible to obtain one permit.
D. 
On-street parking permits are nontransferable.
E. 
On-street parking permits are issued for one year from April 1 to March 31.
F. 
Caregiver on-street parking permits are nontransferable between households. However, caregiver on-street parking permits may be transferred between caregivers providing such service at a given household.
A. 
In all designated Residential Permit Parking District areas, one-hour free parking is permitted.

B. 
Pine Street and Locust Street, from the intersection with Maplewood Street to the Pine Street pedestrian bridge, the hours of enforcement will be from 5:00 p.m. to 7:00 a.m. All other areas will be enforced 24 hours a day/seven days per week.
C. 
All Borough-designated holidays, which include New Year's Day, Good Friday, Memorial Day, July 4th, Labor Day, Veteran's Day, Thanksgiving Day, the day after Thanksgiving, Christmas Day and Community Day, no enforcement of the Residential Permit Parking Ordinance will take place.
D. 
Nothing herein shall limit the discretion of the Etna Borough Police Department to issue warnings in lieu of tickets.
E. 
Council, by resolution, may change the enforcement hours as it deems necessary.

A. 
Any person who violates any provision of this chapter, upon appropriate traffic citations, shall be sentenced to pay a fine of not more than $40 and costs; reduced to $20, if paid within the first three business days, provided that it shall be the duty of the police officers and/or parking enforcement personnel of the Borough of Etna to report to the appropriate official all violations of any provisions of this chapter.
B. 
Each day a parked vehicle is not in compliance with this article shall be considered a separate violation.
A. 
All ordinances, or parts of ordinances, which are inconsistent herewith are hereby repealed to the extent of such inconsistency.
B. 
If any sentence, clause, section or part of this article is determined, by a court of competent jurisdiction, to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article.
C. 
It is hereby declared as the intent of the Borough Council that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included therein.
This article shall take effect immediately.
