It shall not be lawful to set aside, appropriate, occupy or use any land or lands within the limits of Gloucester City for a cemetery or place for burial of the dead without having first made application in writing to the Mayor and Common Council of Gloucester City for this purpose, which application, if approved by a majority vote thereof, shall be marked "Approved" by the City Clerk and referred to the Board of Health[1] of said city, and if concerted in by a majority vote of said Board, such application shall be regarded as granted; and it shall be the duty of the City Clerk, upon application to him, having obtained knowledge of such concord, to issue a permit for this purpose.

Such application shall contain an accurate description of the location of such cemetery or burial ground, by metes and bounds; the name and residence of the owner or owners thereof; the extraordinary purpose, if any, for its establishment; if incorporated, a certified copy of the act of incorporation shall accompany it; whether the bodies to be buried therein are those of residents of the State of New Jersey or elsewhere, or both; and if for a religious denomination or society, the name thereof.
The use and occupation of such cemetery or burial ground, when approved of and established as aforesaid, shall be in all respects subordinate to and in conformity with all the rules and regulations of the Board of Health of Gloucester City and the laws of the state in such case made and provided, as they now exist or may hereafter be legally changed, and any violation of said rules and regulations of said Board, or of said laws of the state, shall be punishable by a fine of not more than $500 or by imprisonment for a term not exceeding 90 days, or by both such fine and imprisonment in the discretion of the Judge before whom conviction is had.
