No person or persons shall show forth or exhibit or cause to
be shown forth or exhibited in any place whatsoever in the City of
Gloucester City for any price, gain or reward, any beast or animal
or menagerie or collection of beasts or animals or any like show or
exhibitions, or any carnival or any circus or any curiosity or curiosities
of nature or art, or any show or exhibition of any kind whatsoever,
or conduct a merry-go-round, swings or other public amusements, without
having first obtained, a license for that purpose as hereinafter mentioned,
under the penalty of $200 for each and every offense.
The Mayor of the City of Gloucester City shall and may in his
discretion, on application for that purpose, give a license in writing
for any such shows, circus, exhibition, performance, merry-go-round,
swing, carnival or other public amusements, and shall designate the
license fees to be paid for each license which shall be such sum as
in the judgment of the Mayor shall be reasonable and fair or as may
be regulated from time to time by the Mayor and Common Council by
a resolution, but in no case shall said license fee for a one-ring
show or circus be less than $200; for a three-ring show or circus,
less than $400; for a two-ring show or circus, less than $300, for
each day said license shall continue, and in no other case shall said
license fee exceed $200 for each day said license shall continue.
The Mayor of the City of Gloucester City shall not give any
license for any show, circus, carnival, exhibition, performance, swing
or merry-go-round until the applicant enters into a bond to the City
of Gloucester City with sufficient sureties to be approved by the
Mayor and in form to be approved by the Common Council, conditioned
for the payment of all damages caused or to be caused to any person
or persons or property through the act or neglect of the proprietors,
managers or operators of such show, exhibition, carnival, circus or
other amusement, their servants or agents, while operating within
the limits of the City of Gloucester City under any such license,
which bond for every one-ring show or circus, exhibition or performance
shall be of the sum of not less than $1,000; for every two-ring show
or circus, exhibition or performance, shall be of the sum of not less
than $2,000; and for every three-ring show or circus, exhibition or
performance, shall be in the sum of not less than $3,000; and any
such bond shall be subject to assignment by the Mayor to or for the
benefit of the person or persons injured or owning property damaged,
or for the benefit of his, her or their heirs or legal representatives,
for the purpose of recovery thereon.
Every license granted as aforesaid shall set forth the place
or places in which such show, exhibition, carnival, circus, performance,
swing or merry-go-round shall be authorized to be held, the time during
which it may continue and the price or prices which may be demanded
for admission to the same, and such license shall not take effect
until the license fees shall be paid.
Nothing in this ordinance contained shall authorize the licensing
thereunder of theaters or moving picture shows.
This ordinance shall take effect immediately.
